Is it fixed? Because i have XBOX Live can i download some kind of patch to fix it?

To answer your question yes the TO bug is fixed, if you have Xbox Live then when you sign on to Live it should say that an update is required which you have to download to get on Live, this update is the patch so once you have completed that process it should restart the game and viola! you are patched.
