Yes, the patch is available for the ps3. I don't know about the 360

First thing I noticed post patch. The Gillette Stadium field looks a hundreds times better! It looks like a completely different game no more random dirt and oil looking streaks on the field that should not be there.

R.I.P. QB Sneak Glitch - just tested it and it's gone. QB does the flop regardless of how many defenders are on the line. Could still pick up a steady yard or two, but no more than that. And a positive gain is not guaranteed if the defensive line stacks the middle.
