We need more lawsuits

SANTA ANA, Calif. -- A man who was denied a red nylon tote bag during a Mother's Day promotion at an Angels baseball game has filed a sex and age discrimination lawsuit against the team.

The class action claim filed by Michael Cohn, a Los Angeles psychologist, alleges that thousands of males and fans under age 18 are entitled to $4,000 in damages each because they were treated unequally at last May's promotion. Women over 18 received the gifts.

Angel officials said Cohn was the only person who complained about the giveaway and that the team is proud of its promotions.

"Historically, we have tried to appeal on those special days that might be nationally noted holidays or special occasions," team spokesman Tim Mead said, adding he could not comment directly on the suit because he hadn't seen it. "We have tailored programs or giveaways accordingly."

The team responded to a complaint letter that Cohn wrote last June by sending him four tote bags and a letter stating the team "ran out of the item that day and had to order more."

"They claimed they didn't have any more bags, but my client said there was a mountain of bags stacked so high a show dog couldn't have jumped over them," said Alfred Rava, Cohn's San Diego-based attorney.

Cohn could not be reached for comment.

This weekend's Mother's Day promotion will offer tote bags to the first 25,000 fans over age 18, rather than cater specifically to women. Mead would not say whether the change was in response to Cohn's complaint.

Rava said the altered promotion still violates the civil rights of fans under age 18.

Cohn's suit names as defendants the Angels and the Corinthian Colleges, which sponsored the event through an affiliate.

Seriously, don't these people have something better to do?

Why can't there be a law that if a judge deems a lawsuit frivolous that he can impose a fine from anywhere up to a million dollars in addition to charging the person who brought the suit for all court fees for the party they are suing? I think a million bucks out of this guy's pocket might make him decide its not worth suing because he didn't get a tote bag on that day.

If I was a lawyer defending this, I would find a way to stack up tote bags and find a show dog to jump over them. That would clearly show that Mr. Cohn lacked credibility to judge how many tote bags were available.

Obviously, this guy is trying to make a point regarding sexual discrimination suits that women have brought regarding unequal treatment.

A lame statement, IMO, but that's what he's clearly doing.

If it were Valentine's Day or some other crap, I might go along with him wanting to make a statement - but it's MOTHER'S Day. If that were the case, you'd think he would pick a day not dedicated to women.

The Curve’s salute to all ridiculous lawsuits ever filed will include the following:

# A Pink Tote Bag Giveaway to the first 137 men in attendance ages 18 and over
# The first 137 women 18 and over will receive lukewarm coffee so they will not burn themselves
# The first 137 kids will be given a beach ball with a warning not to ingest it
# Angels merchandise and novelty items given away throughout the game
# Honoring some of history's "Most Frivolous Lawsuits" during the game

A grand prize drawing in which one fan will receive a “clue” and their own frivolous lawsuit.

Additional details will be announced later

“We realize that these giveaways as part of our Salute to Frivolous Lawsuit Night are fairly stupid and serve no real purpose,” said Curve General Manager Todd Parnell. “But if our fans don’t like them, then they can sue us!”

Curve President and Managing Partner Chuck Greenberg, himself a practicing corporate and sports attorney, declined to comment on his club’s promotion because of concerns that his comments could lead to a frivolous lawsuit.

The Altoona Curve have become widely recognized for the fun, themed nights, including their annual “Awful Night” and the innovative “2006 Retro Celebrity Series”, which is bringing 11 of the most popular names from some of televisions most popular shows to Blair County Ballpark during the 2006 season. The club was honored by Minor League Baseball as the winner of the 2004 Larry MacPhail Award for promotional excellence among all affiliated minor league clubs.

Maybe he was actually trying to highlight how easy it is to make a frivolous lawsuit, and subsequent events have aided his quest to raise awareness beyond even his own initial ideas.

Not to threadjack, but on the Abrams Report they just did a piece on Mexico's foreign minister who is threatening to sue the United States if they use any National Guard to deport illegal immigrants. Mexico wants to tell us how to secure our borders.

I can't find a link to any story online. There should be something up in the next 24 hours on msnbc's website.
