Car Wrecked By Clueless 90 YR Old (and Insusrance ?s)
This sure sucks.
Some old fart decides to just turn into my lane while going the same direction and damage my car pretty bad. Went to the emergency (gf too) for xrays but at least nothing broken. I'm just imaging how much I won't be able to move tomorrow ![]() He hits us and sits in his car staring blankly out the window. Finally asks if anyone is hurt while I'm on the phone with 911. The guy was so out of it he couldn't find his insurance card for the cops and they wouldn't let him drive home and towed his car after ticketing him... This totally fucks up getting a car for the GF and switching insurance compaines (as we had found great rates with someone else) along with doing who knows what to our work situation. I don't know what to do, just venting ![]() Last edited by Chubby : 07-07-2007 at 06:14 AM. |

If it were up to me, nobody would be allowed to drive on public roads at all and this wouldn't have happened.

it's just so depressing that it's by someone who should never have been driving in the first place which is confirmed by the cops not letting him drive afterwards

I've always said that if there is a minimum driving age, then there should be a maximum.

another tragic accident caused by steriods.
in all seriousness, when I was like 19 I got hit in an intersection by some dumb bitch in a minivan; she ran the red light and hit me at about 40mph. I was irritated, but it wasn't until we got out of our cars and she screams at me "WHAT'S WRONG WITH YOU YOU WENT THROUGH A RED LIGHT!!!" that I became truly enraged. oh, and yes, old people shouldn't be allowed to drive. especially at night, they can't see for shit. |

fwiw, my grandfather was 80 when he realized he wasn't fit to drive any more. he had already limited his driving substantially, and was planning to not renew his license when it expired...even though he knew he wouldn't have any problem renewing.

Can a 90 year old really be a fuck?

I hope when I'm ninety I'm out trying to kill off the younger generations before they replace me.

Well the old fuck is tking 100% responsibility so there's no fight over who is paying for everything, his insurance is.
However, both places are saying my car is totalled ![]() I'm looking into the settlement part where I get paid but still keep the car so I'm wondering if anyone knows: I know if I fix and keep the car I can't get paid on a future claim with the car, if I sell the car can the next owner ever make a claim on it if it's in another accident? |

Do yourself a favor. Contact a "reputable" personal injury firm (larger firms are "usually" your best bet) and speak to an attorney about your situation. Most times, the attorney will give some advice about how to handle the insurance companies and, who knows, perhaps you have a valid claim. While this is not a "sue-happy" mentality, it is more for your protection because most insurance companies want to just get rid of your claim as quick as possible, and you might be denied the amount of damages to your car and yourself that you might've been entitled to. If you release the person and insurance company for a smaller sum, you can't go back and attempt to get more if the damages exceed that amount. |

I already did. XRays were negative and I'll get a MRI at some point. The guy's company had wanted to set up a meeting so we're not sure if they are coming at us with a "Here's some money but sign away your right to sue" or if it's for something else. My main concern now if replacing my car or fixing it. I love my car, I want to fix it. I only had 3 payments left before it was paid off and I could get 2-3 more years out of it with no payments ![]() |

At least in my experience, if a car is really totalled, it never seems to drive the same after being fixed. I tried having that done and it never felt like it handled the same way it did before the accident.

I know, I just love my car and it's not like there's tons of used ones like it floating around ![]() Right now the consesus seems to be that the old guy's insurance wants to have a meeting so they can get us to sign off on not suing for damages in the future where they'd offer us money. Haven't really been through something like this before so it will be interesting to see how it plays out... |

For my head on collision, my worst symptoms didn't occur until 5-6 months later so, you may be fine now but, no rush at settling. As for the car, what type of car is it? If it is totaled, I don't know why you would want to keep it unless it was a vintage/classic car. Nothing ever seems right after a car is repaired.

Take the total especially if they need to do anything to the suspension or frame. It sucks that you are 3 payments away but, you won't have the same car back. I've had 2 cars totaled and in both cases, I received back more money than I owed.. (One had 3 1/2 years to go, the other 1 1/2 years to pay on 5 year loans) Everyone gets the injury/doctor bills thing but, make sure you keep track of everything related to this. Even things like time off work for injury, to look for a new car, rentals, going to the insurance place, mileage, etc...
