Took the jury less than an hour.
CNN: Jury finds 'windshield death' defendant guilty (http://www.cnn.com/2003/LAW/06/26/windshield.death/index.html)
I still can't fathom how someone could actually leave another person to die like that. :(

The details of that case, as initially reported, were just too chilling for words.

If I remember right, her defense was "I was on X and too scared to call the police." You know you are screwed when that is the best you can come up with.
At that point, the best thing to do is plead "guilty", and get your massive prison sentence rolling.

I recall some details of the story (I am not vouching that these were true, only that these were reported) that the woman parked the car in her garage and went inside for some time while the man remained impaled in her windshield. She supposedly spent time around the house, including having sex with her boyfriend, while she "mellowed out" from her intoxication and decided what to do about the predicament. Over the course of that time, the man's injuries eventually caught up with him and he eventually died (bled to death?). Just awful.

For those of you willing to take an unpleasant trip down memory lane, this is a link to our discussion of the case from the old board. That thread also provided a link to a news article from when this was first reported (linked below as well).
One of the most mindblowing stories ever (http://dynamic2.gamespy.com/~fof/ubb/ultimatebb.cgi?ubb=get_topic&f=1&t=008848)

In the original story, didn't she also go back out to the car while the guy was alive and tell him she was sorry? There were three things that really struck me the first time I read the article:
1) The go into the house and have sex with the boyfriend while the guy was dying on her car.
2) The fact she went out and spoke to him a couple of times.
3) Her "friends" told her to destroy the car and the evidence.

Thanks for the link, Craptacular. That first linked thread was a pretty good discussion...

Mallard's legal team never disputed that she killed Gregory Biggs, 37, in the predawn hours of October 26, 2001, after a night of drinking, smoking pot and taking Ecstasy. But they said the death was an accident -- not murder.

Yup, dont feel sorry for her in the slightest

I guess the prosecution was able to prove that by leaving him bleeding and dying in her windshield, she murdered him. If she had taken him to the hospital, she may have gotten off with probation. Well, maybe not, but certainly less than she is going to get now.

In criminal law, one of the first things we learned was all of the theories behind punishment--revenge, deterrence, etc..
In this case, I think that all of the theories are applicable. Most applicable, IMHO, is the theory of incarceration. Simply put--even with issues of right and wrong aside (and she is about as "wrong" of a human being as there can be in this world)--this woman needs to be locked in a cage for the rest of her life so she cannot be out and about affecting others. The world is a better, safer, happier, more auspicious place if she is not moving around freely in it.
