Jury Awards Father $2.9 Million in Funeral Protesters Case

A federal jury on Wednesday awarded the father of a fallen Marine $2.9 million in compensatory damages after finding a fundamentalist Kansas church and three of its leaders liable for invasion of privacy and intent to inflict emotional distress for picketing the Marine's funeral in 2006.

The jury was to begin deliberating the size of punitive damages after receiving further instructions, although U.S. District Judge Richard Bennett noted the size of the compensatory award "far exceeds the net worth of the defendants," according to financial statements filed with the court.

Albert Snyder of York, Pa., sued the Westboro Baptist Church for unspecified monetary damages after members staged a demonstration at the March 2006 funeral of his son, Lance Cpl. Matthew Snyder, who was killed in Iraq.

Church members routinely picket funerals of military personnel killed in Iraq and Afghanistan, carrying signs such as "Thank God for dead soldiers" and "God hates fags."

A number of states have passed laws regarding funeral protests, and Congress has passed a law prohibiting such protests at federal cemeteries, but the Maryland lawsuit is believed to be the first filed by the family of a fallen serviceman.

Snyder's suit named the church, its founder the Rev. Fred Phelps and his two daughters Shirley Phelps-Roper and Rebecca Phelps-Davis, 46. The jury began deliberating Tuesday after two days of testimony.

The York, Pa. man claimed the protests intruded upon what should have been a private ceremony and sullied his memory of the event.

The church members testified they are following their religious beliefs by spreading the message that the deaths of soldiers are due to the nation's tolerance of homosexuality.

Their attorneys argued in closing statements Tuesday that the burial was a public event and that even abhorrent points of view are protected by the First Amendment, which guarantees freedom of speech and religion.

The judge said the church's financial statements, sealed earlier, could be released to the plaintiffs.

Earlier, church members staged a demonstration outside the federal courthouse, which is located on a busy thoroughfare a few blocks west of Baltimore's Inner Harbor, while passing motorists honked and shouted insults.

Church founder Fred Phelps held a sign reading "God is your enemy," while his daughter Shirley Phelps-Roper stood on an American flag while carrying a sign that read "God hates fag enablers." Members of the group sang "God Hates America,"' to the tune of "God Bless America."

Snyder sobbed when he heard the verdict while members of the church greeted the news with tightlipped smiles.


I hope more families of dead soliders decide to file suits against these people.

Fred Phelps is one of the few people on this planet with whom I can say without regrets that I can't wait till he's dead. I hope people picket his funeral.

Honestly - Fred Phelps is a non-entity - its a 40 person church that basically exists to gain attention - I don't think they are recruiting members as much as attention whores. The attention the news media gives them is significantly disproportionate to their impact.

PS - None of this is meant to suggest their impact on the specific funerals isn't huge - if it was my family member, I'd cold cock the guys involved. Just on a larger scale - I bet even your average white supremacist dislikes Phelps.

If I were at my son's funeral or something and these fuckers came along and protested it, it would take every piece of me to prevent killing the guy with my bare hands.

Kind of ironic that Fred Phelps - who admitted more or less his intention with his "church" is to hopefully profit from a lawsuit should someone physically attack them during a protest - is getting stuck by the same sword.

There are few people I have more respect for than a soldier who pays the ultimate price, and to disgrace that honor would push buttons in me beyond my level of self control.

I mean sure a company gets sued for 2.9 million they can get themoney by seeling the company if they have to.ut, what can these three people do to get htis money . It just appears to be a statement by the court nothing of any real substance as far this family getting ANY money from these bozos.

As someone else has pointed out, this is part of what they're counting on. They have a pretty public plan to sue the heck out of anyone who assaults them. Hence the irony.

I am not a lawyer, but I think once the decision has been handed down, there are a lot of things the fed can do to acquire the money for the plaintiff.

Yeah, I would be surprised as well. I'm pretty sure Bubba is no fan of the gays, but I'd be surprised if he'd condone these kind of actions.

I'm not defending Phelps in any way, but 2.9 mil in compensatory damages seems way out of line. No way that stands at that level on appeal. The punitive damages will also be reduced, but they at least seem more reasonable to me. I don't like the precedent of saying a memory is worth millions of dollars.

That being said, I hope taking Phelps to court gets rid of him. As someone said above, nationally he's not that important, but no family should have to deal with his crap while burying their child.
