If you are 18 and you are pulled over by the cops, do they have any legal right to call your parents? My friend was pulled over and accused of being drunk based on the eye hand test. He demanded a breathalizer test and the cop said he didn't have to give him one. My friend doesnt even drink to begin with but the cop called him a liar and proceeded to call his parents and tell them that he had been drinking anyways. Needless to say, his parents dont believe him, they believe the cops. But as I posed earlier, do the cops have any legal right to call your parents if you are over 18? The police said that he looked 16 so they had call based on that fact. I call bullshit though and it's their job to know someone's age before they go calling parents. They don't cite my friend, but his parents are totally pissed at him for drinking. Would a complaint be worthless and fall on deaf ears?

I don't know if this matters or not, but some states the legal age is 19 for this sort of stuff and not 18.

Yes, a complaint would be worthless and probably would antagonize the police so next time your friend ends up in the slammer. And did your friend not have his license with him? How did they not know his age? Lastly, if the cops wanted to, they could probably call your parents if you were 30 or 50. The impact of doing so probably lessens as you get older.

Uh, Those Eye Hand tests are pretty simple..
Arms out, feet together.. touch your nose
Not trying to pass judgement, but if your friend failed that being sober, he probably shouldn't be driving.

Another thought. Was the car his, or his parents? I'm sure that if it was his parents, that would give them the right to call them.
