This wasn't a story until the Wendy's finger story broke, but now that body parts and fast food restaurants is a big news item, time to dust off an old one that no one gave a crap about last year or earlier this month when the lawsuit was filed.

Anyway, this one seems legit. Maybe they can get Gil Grissom to lift a print and match it to the manager...

Man says he found skin on sandwich

DAYTON, Ohio - A man is suing a fast-food restaurant operator for more than $50,000, claiming he found a slice of skin on his chicken sandwich.

David Scheiding filed the lawsuit in Montgomery County Common Pleas Court on April 1 after rejecting a settlement offer from GZK Inc., his lawyer said. GZK owns the Arby's restaurant in Tipp City where he bought the sandwich.

Scheiding said he realized something wasn't right when he bit into the sandwich on June 18 and found a piece of flesh about three-fourths of an inch long.

"It looked like I was seeing fingerprints on it," he said. "I got sick and went to the bathroom."

Miami County health investigators talked to the restaurant manager, who had a bandage on his right thumb and wore a latex glove, according to a health district report. The manager said he sliced skin from the thumb while shredding lettuce, and sanitized the area but didn't throw away the bin of lettuce, the report said. Scheiding's sandwich contained lettuce.

"Why wasn't the food searched, and why wasn't it thrown away?" said Scheiding's lawyer, Hank Hyde.

Christine Koeller, vice president of marketing and communications with GZK, said what happened was unintentional.

"(The manager) did destroy product that was in and around the slicer immediately, and did everything that he thought was appropriate to do," Koeller said.

I think the title should be phrased as an old SAT question.

Wendy's is to fingers as Arby's is to _______.

How is 50K arrived at? Just give the guy a coupon book. No harm, no foul.

I agree. What are the damages here, other than being disgusted?

Seriously. I'm hoping for skin in my burger then. I'll eat a quarter sized piece of skin for some bling. I have faith in my digestive team.

"It looked like I was seeing fingerprints on it," he said.

I wish the (scraped, sliced, and bandaged) manager had denied any involvement. I've heard of leaving fingerprints at the scene of the crime, but this guy really left fingerprints.

If there was any blood or flesh on the skin there's a decent chance of catching something (if the "donor" had anything).

Considering the manager had a bandage on, it probably was a bit more than just skin...

I'm not saying the whole concept is correct but as it stands now 50K or any amount is arbitrary.

If he contracts something go for 12 billion. For now, get it on record, take your coupon book and go home.

I'll gurantee you if the guy saw blood or flesh on the thing it would be more than 50K.

The guy should have kept his mouth shut, taken the skin, lifted the fingerprint, then robbed area Arby's using the lifted print.

Very Bourne Supremacy-ish.

I think he should have gone for free roast beef sandwiches for life.

Have you seen the price of Arby's sandwiches? Giving out a coupon book would be much more financially damaging to the chain than forking over $50K.
