i was trying to figure out if there is any way my beloved (crappy) 49ers can still get the #1 pick for next season...does anyone have a link to a what has to happen type of thing?
From today's Washington Post
If the Texans lose today, they get the No. 1 pick because they will have the league’s worst record.
If Houston wins, five teams could finish 3-13. The No. 1 pick would go to the team whose opponents have the lowest winning percentage; that is, the one that played the easiest schedule.
Right now, the Saints appear to be in the lead there.
If the Saints and Texans win, things get fun.
A Lions win over the Steelers would hurt Green Bay; wins by the Colts and Raiders would hurt the Jets; and the 49ers would be greatly helped if Green Bay and New Orleans both win. The last time both won on the same weekend? Last Jan. 2.

Just watch for my updates in the NFL Week 17 item. To answer your question, no the 49ers can not draft higher than #2 - more likely 3-5 if they lose.

As a 49ers fan, I wouldn't mind getting the #2 pick if the Saints have #1. There's at least a decent chance that the Saints would prefer Leinhart to Bush given their situations at QB/RB, so there's a chance for a trade there. Not sure if it's still possible for the Texans to finish behind SF, though.
