Ok...what to do...Prescription Fraud

What a way to ruin my buzz and night....

I just found out that someone in my immediate family committed prescription fraud in my name about 7 to 8 years ago, and it is in my DOPL records.

I also know they did it to my younger sister who currently has her Masters in Pathology and has applied to several government positions and is looking at med school as well, she is worried this is going to hamper and effect her.

I am getting ready to go under some goverment background checks as well.

My questions are this if anyone knows:

1) Will this affect me and my sister with our gov background checks?

2) Can I do anything about it?

I have no idea about the effect on you. However, it will likely hurt your sister. Medical schools might not find out about it if/when they admit her, but a state medical licensing board will almost certainly find out about it. A friend of mine had a felony offense similar to this in his background and he still hasn't been able to get his medical license as a result. This has led to him working as a lab researcher and making much less money than he would otherwise, yet he is still burdened by the same high level of medical school loans that most graduates have and it is creating a tremendous hardship on him. He has a lawyer currently trying to fight this, but this fight has been going on for over a year. If your sister is dedicated to pursuing the field of medicine, I would recommend she attempt to get this expunged from her record as soon as possible with the help of a good attorney.

I misread the last part of your post...

We do not have charges on us, we just found out that the scripts were written and filled in our name.

My ex Step-dad worked at a printer that printed script pads and he stole a bunch, and filled them in basically everyones name (Both my sisters, my mother, mine and my brothers).

It just came out in a Jerry Springer moment between my sister with her Masters and my Mom, and now my sister is flipping out.

So no charges have been filed, it's just we know that our names were used 7 to 8 years ago to get oxycotin, which is a drug that none of us take, and something I would refuse to take if it was prescribed by any doctor.

Oxycontin may be a problem when it shows up on your background checks. The question is going to be what did you take it for, etc, etc. Some guy looking at the records may wonder if you had a drug problem. Of course that depends how many times perscriptions were filled in each person's name.

But I think Hippa is going to prevent anyone from finding anything out about your prescription history....

That would be medical information, and could lead to ADA violations if you were denied employment

But he's applying to government positions (as is his sister). ERISA (of which HIPPA is a part) has exceptions for the government. I'd imagine government agencies like the FBI and CIA would like to know their applicants' perscription histories to look for any drug abuse problems, and I'm sure HIPPA won't stop them from getting that.

There may be an easy answer. Can you easily prove through documentation, 3rd party testimony, etc. that you had nothing to do with the prescriptions? If so, come clean, let investigators know about it in advance, and then show them the evidence when asked.

That is more than easy, for me, I had never seen the doctor my prescription was written from and for my sister, she was out of the state in Memphis, going to school when this happened.

Stupid question here but what is that? I have heard it refered to but never really looked to see what it is. Usually it's stories about someone trying to get it illegally so I am assuming that it is a big time pain killer or antidepressant.

If there are no charges, I wouldn't push the issue for yourself. It sounds easy enough for your sister to fight, since whe wasn't in the area when it happened but it may be more difficult for you as it may point towards you as committing the fraud since it would be your word against his (not sure of your relationship with him so I don't know if he would try to make you be the fall guy).

It's a big time pain killer. Strong opioid that is easy to get high from and is highly addictive - also one of the easier medications to overdose on and die.
