Looks like that has something to do with domestic abuse laws in California. I've seen several explanations of it but this one (http://www.el-cerrito.org/police/domesticviolenceassist.html) from the El Cerito PD seems more official than the litany of abuse lawyer websites.

Doubtful to me, since (I figure) she's basically swearing to what's occurred.
Just because a prosecutor fails to convince a jury of those events beyond a reasonable doubt doesn't automatically mean she's not telling the truth.

Actually from what I just read, the DA sent the case back to the sheriffs department with more questions (which looks like it has now been sent BACK to the DA).

The Sept 15th day is a court date, doesn't mean that charges will be filed.

Yes, I understand that, but it is now Friday. Where were they on Tuesday and Wednesday and Thursday? Does it take that long for bruises to show up? I can see a day or two at most. Maybe she has thick skin?

There's also sources (employees at the club) that saw her drinking at a club that same night, but, she claims she is allergic to alcohol.

Both her and Merriman are dumb and there's probably a grain of truth in both of their stories, but, her credibility is lacking for sure and its not like she isn't a publicity hound. The old saying in Hollywood, "Any publicity is good publicity".

She was drunk and Merriman did not want her to leave and drive drunk and told her she couldn't leave unless she took a cab.

She got pissed at him for not letting her leave, called the sheriffs and made a citizens arrest.

If he did hit her or choked her, he should go to jail. If she filed a false police report, she should get in trouble (fined, community service, whatever).

If he was banging two chicks and she didn't want to join them, I quote Meat Loaf: "Two out of three ain't bad".
