49ers still may get 3rd round pick for Owens

Update on Brandon Whiting

Brandon Whiting will remain with the 49ers…for now.

The defensive end will have shoulder surgery performed by 49ers medical personnel and the team will have until September 1 to clear him for a physical. That date was reached in an agreement with Philadelphia.

If, at that time, Whiting does not pass the physical, he will be returned to the Eagles and the 49ers will gain Philadelphia’s 3rd-round selection in the 2005 draft.

49ers.Com will bring you more on the situation as it develops, including the schedule for his surgery.

Personally I thought the 49ers got stiffed with Whiting. Owens and his agent crapped on the floor, and the 49ers had to clean it up. I know that September 1st is a long ways off, but if this guy can't pass a physical by then I'm almost positive the Eagles will go cry to the players union.

Wouldn't they have had a 3rd round pick anyways if this whole thing had never happened? I thought that was the compensation for losing him as a FA...

I think that applies if he was a restricted FA...

49ers are lucky they got anything for him. When the arbitrator says to you.. "Your case is kind of weak, isn't it?" You know you're not going to win. Owens could have stuck it out and got free agency.

When the arbitrator says that in this case, you know who's handing him his check after the whole process...

Or, he was being honest and they didn't have a case (they didn't).
