Good Article about Some Facts in Kobe Trial

CNNSI had an article today that does a pretty good job of discussing the DNA and blood evidence (without sensationalizing or attacking):

Interesting. I still think Kobe is gonna get away with it.

It won't be a pretty trial for Kobe, but it still comes down mostly to a he said she said case. I don't even think this thing will go to the jury, but if it does I think the civil case already being filed hurts her more then she might think. It's like a big neon sign saying I am in it for the money stupid.

I disagree. I think the civil case says "I think the prosecuting attorney in the criminal trial is incompetent, and the only way I'm getting any justice here is if a high-paid private lawyer can argue my case for me."

Thanks for the article. I hadn't seen anywhere that they had concluded it was her blood on his shirt. That's not good news for him.

As for the civil suit, that's standard practice, especially when it seems the criminal case is going badly. That can be easily ignored by a jury.

"If she is sexually active," explained Garrison, "she is not going to hurt and bleed if she had consensual sex with Kobe. You only bleed if you don't want it to happen."

That's BS.

clintl 08-31-2004 03:01 PM

Coupled with the medical findings by the exam nurses, who are trained experts, it's not BS.

Quote:

Next her parents drove her to Valley View Hospital, where two nurses trained in sexual-assault cases conducted a rape-kit exam. SI has learned the exam revealed "multiple lacerations" and "bruises" between the vagina and anal opening. The nurses, noting the subject had not showered or douched since the encounter, described the injuries as genital "trauma" inconsistent with consensual sex.

I think they should measure Kobe's Dong and see if that could of caused the bleeding.

If it doesn't fit, you must acquit?

From the article: "When asked how he knew the woman wanted to have sex, Bryant said he could tell from the look she gave him."

Anyone else catch this? This just doesn't sit right with me. I've always given Bryant the benifit of the doubt in this case. Hearing this about DNA evidence and that about blood and all the other shit that's come out.

But this just doesn't look good to me. He knew she wanted to have sex because of a look she gave him? He didn't say because she was all over him, taking her clothes off while dry humping his leg. He didn't say because she came out and stated she wanted to have sex. It was because of a look? That doesn't sit right with me.
