In fact, my guess, is given the timing, that the wolves (maybe Tyrith the DO himself) had this one time power to free a prisoner at any time (day or night), and they had a wolf on the hook with clap. So they decided to try to get Schmidty to duke to pass by "releasing" him early. And if it didn't work, well, clap was on his way to jail, not a lynch.

That seems like a pretty good theory.
