Normal, non-criminal people don't initiate and commit murders, but when we find ourselves in a street fight (even if we started it), or someone breaks into our house, how can we judge that exactly the same as the clear premediated killer?

I'm getting my law knowledge from Law and Order, but isn't it still murder if someone dies because of a felony he committed...regardless of what the felony is?
