His status was flagged when he came back. I doubt it was for MJ but more because he missed his court date. He may have a legit explanation for that, but all ICE had at the time was his record was flagged.

We actually don't know that. Was, the DUI a felony, did someone get injured or were there a lot of damages? Did he report his drug use and/or DUI on his green card application? etc.
Depending on the circumstances, his green card may well be in jeopardy if he lied on the application.
(And for the record, I personally think Harry lied on his green card application about drug use, and if true, should be kicked out)

I assume you are referring to the "torture". If true, no excuses and those guys should be fired.
