I have buddy in Orlando who represents lawyers in disciplinary proceedings. I assume he will enjoy this one.

Reminds me of the story 20 years ago of a guy that sent back a jury notice after he'd wiped his ass with the paper. The judge was not amused.

FWIW, these kinds of headlines are garbage. Sending the picture of Flava Flav is not the reason for his disbarment, is not the reason he is or has been recommended for disbarment, is not a mitigating factor in his disbarment proceedings. While it is indeed true that the order of events include this lawyer sending a picture of Flav and at a later date a disbarment hearing being scheduled, these events have no bearing on the other. Correlation does not indicate causation. To wit, I'm sure this lawyer has at some time in the past eaten at Olive Garden. "Lawyer eats dinner at Olive Garden, disbarment ensues" is equally as accurate and at the same time equally as meaningless. Maybe something along the lines of "Lawyer facing disbarment sends picture of Flava Flav to ODC" would be better suited to this discourse, but I'm sure OP will figure it out quick, fast, and in a hurry, don't worry, Flava vision ain't blurry.

While you are right that I was using the headline for the sake of effect, the picture was actually relevant, even as I might have stumbled into that ass-backwards.

The legal question was whether the ODC erred in holding that he consented to disbarment. He did not fill out the formal paperwork required for a consent, which is--on the face of the statute--required. But the board found that his behavior, including the Flava Flav pic, constructively amounted to consenting to a disbarment.

But several members of the ODC dissented from the consent finding. And there were dissents in the D.C. Ct. opinion noted above. So the pic was actually pretty relevant evidence regarding a legal issue that was disputed all the way up.
