She Allegedly Gave Kids Alcohol Before NYC Field Trip




Jun. 13, 2005 - A southern Kentucky teacher is facing charges she gave her high school chorus students alcohol before a field trip to perform in New York City, and one of her students told police that the teacher had taken "half nude" photographs of him and a female student in their high school chorus room.

Choir teacher Danielle Brown was arrested Thursday morning after Franklin, Ky., police executed a search warrant at her Bowling Green home Wednesday night, looking for computers, a digital camera and other items. Police have refused to release details about what was found.

Brown, the wife of a Baptist preacher who quit her teaching job on June 6, after school officials learned of the allegations that she had given students alcohol, was charged with six counts of unlawful transaction with a minor in the third degree.

The trouble allegedly started on the night of June 2, when the 21 members of the high school chorus stayed in the school overnight in preparation for a 4 a.m. departure to catch a flight to New York City, where they were to perform at Carnegie Hall.

"It was meant to be a special, special trip," Simpson County Schools superintendent Jim Flynn said.

Brown, however, apparently did not make arrangements to have two parents serve as additional chaperones, and the students were alone with her overnight, Flynn said.

School officials learned the next morning that Brown allegedly gave some of the students alcohol, though they declined to say how they learned about the events of that night.

When Flynn learned that Brown was the only chaperone with the students in New York, he sent Franklin-Simpson High School Principal Gary Houchens to join the group.

With the principal along, the group performed at Carnegie Hall, and Brown offered her resignation, Flynn said.

But that was not the end of the alleged problems. Brown and two students did not return from New York with the rest of the choir on June 6, and then the three missed another flight they were supposed to take the next morning.

The airline had overbooked the flight the group was supposed to take on June 6, and one of the students was going to have to stay behind, but Brown offered to stay instead, Flynn said.

"One student kind of got upset that the teacher was being left behind and left the gate," he said. "Another student went to assist that student and the flight had to leave. Consequently those students missed the flight."

The next day they missed another flight home and parents became worried, so Flynn called police in New York and asked them to escort the students and Brown to the airport, he said.

"It's a terrible experience," Flynn said. "Parents put their children in our care and that's an awesome responsibility and it's a very important responsibility and we take it very seriously."

It was after Brown and the two students finally returned late Tuesday that a boy told police "that Danielle Brown did take pictures of him and another female student in the chorus room of Franklin-Simpson High School and that they were 'half nude,'" according to the search warrant issued to police in Warren County to search her home.

"Someone told me the police had been out here but I didn't believe them," said Janet Taylor, one of Brown's neighbors. "I'm thinking why would police be at the church people's house? I couldn't believe it because they go to church and stuff all the time. I just couldn't believe she would do something like that."

Police had a search warrant to seize numerous items from Brown's apartment, including a Kodak digital camera, seven floppy disks, a DVD player, an mp3 player, seven compact discs, two cellular phones, and a computer and hard drive.

The Simpson County attorney said he does not feel it is appropriate to comment about Brown's arrest at this time. The Franklin Police officer who handled the case did not return phone calls from ABC News affiliate WBKO-TV in Bowling Green.

Brown, who has declined to speak to reporters, was released on a $3,000 surety bond from the Simpson County Jail. ABC News affiliate WBKO-TV in Bowling Green, Ky., contributed to this report.

TAMPA - Prosecutors have offered a plea deal to Debra Lafave, the former Greco Middle School reading teacher accused of having sex with a 14-year-old student last June.

But her attorney told Hillsborough Circuit Judge Wayne Timmerman Thursday that he wants more time to review the state's "very detailed" 37-page psychological evaluation of Lafave before sitting down with her and her parents to decide whether to accept the deal.

The judge told defense attorney John Fitzgibbons and prosecutor Mike Sinacore to return to court July 18, the day Lafave's trial was scheduled to begin. By then, both attorneys said, they will know whether they can resolve the case with a plea bargain - or whether they will go forward with a trial they both had hoped to avoid.

Sinacore did not reveal details of the plea deal. Fitzgibbons would not say whether the state's offer includes prison time for Lafave, who is charged with two counts of lewd and lascivious battery, second-degree felonies punishable by up to 15 years in prison for each count.

Fitzgibbons did say the state's offer would resolve Lafave's charges in Hillsborough County as well as those in Marion County, where she faces two counts of lewd and lascivious battery and one count of lewd and lascivious exhibition involving the same teen.

In Hillsborough, Lafave, 24, is accused of having sex with the teenager in her townhome and at Greco Middle School. In Marion, authorities say she and the boy had sex in the back of her silver SUV while the teen's cousin, 15, drove them around Ocala.

Fitzgibbons and Sinacore have both said they would rather avoid a trial, given the anticipated media frenzy and the stress and embarrassment it could bring for the student, who would be called to testify.

At issue are two opposing psychological evaluations of Lafave. Fitzgibbons' psychologist says she has "issues," and he is pursuing an insanity defense. He said his psychologist concluded "Debbie is ill."

The state's psychologist concluded Lafave was not insane when the alleged acts occurred, Sinacore said. Neither evaluation is being released to the public.

Fitzgibbons said he got a copy of the state's evaluation Wednesday. He wants his psychologist to review it before he entertains the state's plea offer.

"The next couple of weeks are going to be crucial in this case," Fitzgibbons told reporters. "We don't know what we're going to do."

He would not say whether he will consider an offer that includes prison time for Lafave, a University of South Florida graduate and longtime south Hillsborough resident who has never been in legal trouble before.

But the timing of the case against Lafave is difficult, he said, given the current no-tolerance approach to sex offenders - a reaction to the murders of two Tampa Bay girls whose accused killers are sex offenders.

"With everything going on in the Legislature, these are terribly, terribly serious laws whether you're a man or a woman," Fitzgibbons said. "You're talking about 50 or 60 years in prison."

SAN JOSE, California (AP) -- A convicted child molester jailed in California may have committed sex crimes against thousands of victims, police said Thursday after finding computers, notebooks and meticulous, handwritten lists of boys' names and apparent codes for various sex acts.

San Jose Police Lt. Scott Cornfield described 63-year-old Dean Arthur Schwartzmiller as "one of the most active child molesters we've ever seen."

During a search of his bedroom in San Jose, police discovered binders full of child porn and numerous logs with lists of more than 36,000 children's names -- mostly boys -- and codes that appear to indicate how he abused them.

"If one-tenth of these numbers are accurate, we're looking at hundreds of victims in a number of states. The reason we want to tell the world about this is because we believe he's been involved in child molestations in a number of countries," Cornfield said.

Schwartzmiller was being held without bail on one count of aggravated sexual assault on a child and six counts of lewd and lascivious conduct on a child, with each count alleging multiple victims. He was arrested in Washington state late last month and sent to San Jose on June 7.

A message left for his public defender was not immediately returned Thursday.

Authorities said Schwartzmiller apparently gained the trust of victims and parents by working as a home renovation contractor. San Jose police got involved after he allegedly befriended at least two boys in the city with gifts, invited them to his house for video games and movies, and molested them.

Schwartzmiller apparently did not register as a sex offender, so his history did not appear in the "Megan's Law" databases in California or other states, authorities said.

"It's as shocking to me as to you," said Sgt. Tom Sims, a supervisor with the department's child exploitation division. "I've never seen anything like this."

Although police said Schwartzmiller appears to have spent much of the past 30 years in California, he has been arrested on child molestation charges in New York, Arkansas and Washington. He also served prison time in Idaho for child molestation in the late 1970s, and is wanted in Oregon on sexual assault charges involving a minor.

In the 1980s, he lived in Brazil, and was extradited from there to Idaho again in the later part of the decade to serve more time, Cornfield said. Police believe he may have victims in Brazil and Mexico.

Authorities also arrested Schwartzmiller's roommate, another convicted child molester wanted for violating parole in Oregon. Fred Everts was charged with child molestation in San Jose.

In a separate case, Edilberto Datan, a 61-year-old San Diego man who has admitted to traveling to his native Philippines and having sex with eight underage boys, was sentenced Thursday to 17 years in federal prison and lifetime supervision.

The retired auditor for the California Department of Real Estate was arrested in 2004 at the airport in Los Angeles upon his return from the Philippines. Authorities said they found about 150 sexually explicit images of 18 teenage boys in his luggage and digital camera. Eight of the children were identified and located.

SAN JOSE, California (AP) -- A man who authorities say could be the nation's most prolific child molester was crafting a lengthy memoir about his sexual exploits with boys when he was arrested, police said.

Authorities also said they have cracked "99 percent" of the detailed code that Dean Schwartzmiller used in notebooks he kept, apparently to chronicle crimes both real and imagined.

Schwartzmiller was arrested earlier this month after investigators said they discovered notebooks with 36,700 handwritten entries of boys' names, descriptions of their anatomy and codes for suspected sex acts.

The notebook entries, apparently coded for each boy's anatomy and personality, are being entered into a spreadsheet. But police said they have not determined how many victims there were because many items are duplications, and some may describe Schwartzmiller's fantasies.

San Jose Police Lt. Scott Cornfield said investigators seized a typed memoir that Schwartzmiller had been writing about his exploits with boys. The manuscript is about an inch-and-a-half thick.

In Schwartzmiller's words "every boy was beautiful and every one wanted him," Cornfield said.

Schwartzmiller is being held without bail on one count of aggravated sexual assault on a child under 14, and six counts of lewd and lascivious conduct on a child under 14 involving two 12-year-old cousins. He faces two life sentences if convicted.

Schwartzmiller is not talking to police and apparently has not been very forthcoming with his public defender either. His lawyer, Melinda Hall, said she still knows very little about the case and is not getting much information from her client.

"I've learned more from the newspaper," she said.

Prosecutor Steve Fein won't discuss how many alleged victims they've heard from, or whether any of the reports might result in additional charges against Schwartzmiller.

A convicted sex offender -- but not a registered one
But as investigators follow up on hundreds of phone tips from around the country, they say they are confident Schwartzmiller will not go free again, as he has in the past despite at least three molestation convictions and a dozen arrests across over three decades.

"This time we've got him," Cornfield said. "This guy's not going anywhere."

Police also said they confiscated CDs, DVDs and videotapes, including child pornography, as well as computer servers and hard drives, which are being evaluated by specialists at the FBI's Regional Computer Forensic Laboratory in Menlo Park.

Investigators say Schwartzmiller, who went by a variety of aliases and earned a living doing stucco work, repeatedly avoided trials and got out of jail or prison early. Despite his lengthy criminal record, he was not required to register as a sex offender.

It was a minor traffic accident on May 17 that brought Schwartzmiller to the attention of San Jose police. According to police, Schwartzmiller appeared ready to exchange information until the other driver suggested contacting the police.

That's when Schwartzmiller fled.

Police tracked down his address and went to his home, but he was not there. However, they spoke to his roommate and former prison buddy, Fred Everts, 34.

Suspicious, they checked Everts' background and found that he had two previous molestation convictions and arrested him on an outstanding warrant for a parole violation in Oregon.

Meanwhile Schwartzmiller heard about Everts' arrest and quickly fled to Washington state.

From there, he called one of the boys he is accused of molesting and asked him to go to his house to "remove and destroy paperwork, CDs, computer drives and other items," a police report shows.

The boy and his siblings decided to tell their mother, who went to police with evidence, including a CD containing photos of her semi-naked son. Schwartzmiller was arrested two days later.

Schwartzmiller may not be talking, but Everts, who has been charged with molesting one of the same San Jose boys, is apparently eager for a deal with prosecutors.

Everts has met with police at least seven times, helping to put together a case against his roommate, according to his public defender, David Hultgren. Everts, too, faces life in prison if convicted under California's "three strikes" law.

"He's freaked out about the whole thing, understandably so," Hultgren said. "I said, 'Look, he wants to help.' I said, 'Fred wants to cooperate."

SELMA, Ind. - A middle school principal who shocked some parents and community members by what they described as suggestively dancing with male students at a talent show will not be fired, a school official said.

Alice Mehaffey, principal of Selma Middle School and an assistant superintendent, likely will be back in the fall, said Liberty-Perry schools Superintendent James Craig.

He said the school board did not decide whether or not Mehaffey should be punished, instead leaving it up to Craig.

"The board said it's a personnel issue that the superintendent will handle," Craig said Wednesday. "I am not recommending that she be dismissed from the position. She's apologized to the community. I think we're trying to move on. I expect her to be on our staff for the 2005-2006 school year."

Some community members said Mehaffey's behavior at the show was inappropriate.

She wore short shorts, had a male student pretending to be a police officer handcuff her and tore the T-shirt off another boy during an encore of the songs "YMCA" and "Macho Man."

The Star Press of Muncie could not reach Mehaffey for comment. No listing was available for Mehaffey in Selma or nearby Muncie.

Selma resident Bonnie Swingley said she hopes Mehaffey has learned a lesson. Swingley's granddaughter attends Selma Middle School in the community 5 miles east of Muncie.

"Everybody makes a mistake, but that was really so seductive to the kids," Swingley said. "I hate to see anybody in her situation get fired. I just hope that from this that her act can be cleaned up."

Church probes school sex

A FEMALE schoolteacher is being investigated over allegations she had sex with a Form Six student at a local Methodist high school.

The allegations have prompted the church to call for greater screening of teachers sent by the Ministry of Education.

It is also calling on the ministry to act on a request that the church screen all teachers posted to its schools.

It is not clear at this stage, whether the female teacher of John Wesley College has been told to go on leave or not because the Ministry of Education is not aware of the case.

But Methodist Church president, Reverend Jione Lagi, has confirmed receiving a report last week of a case of sexual misconduct.

"The church's education department has started investigation this week after receiving the report," Mr Langi said.

He expressed disappointment at the report, saying such cases would see the church push for screening of all teachers at its schools.

"We have always asked the Ministry of Education that we have a voice in the appointment of teachers posted to church schools," Mr Langi said.

However, he said their request to the ministry was never addressed.

"Now we have no choice but to screen the teachers who will apply to teach in church schools."

Mr Langi said new graduates as well as the teachers who were teaching at the schools would be screened.

"It has come to a stage where we cannot sit around and do nothing about this kind of situation.

"It is getting worse because cases of sexual misconduct is happening almost every week," Mr Langi said.

"The church does not condone such offence so we are making our stand now and that is to screen the teachers."

Mr Langi could not reveal the details of the report but said that the church was working closely with the Ministry of Education on the matter.

Education deputy secretary Filipe Jitoko said he was not aware of the case and referred the questions to the Secondary Education department.

Department director Suliasi Lutubula could not be reached for a comment.

John Wesley College principal Akau Tuifagalele slammed the phone down when asked about the incident.

The Fijian Teachers Association is disgusted with the number of sexual misconduct cases that have continued to surface.

General secretary Maika Namudu said the FTA would take the issue up at next month's education summit.

"This issue needs to be eliminated. We can't afford to have this problem around us so we must act now and fight it," Mr Namudu said.

Police spokeswoman Acting Assistant Superintendent Unaisi Vuniwaqa said the case had not been reported to police.

"It is sad that when these things happen, the victims don't come forward to lodge a report because it is defilement and is a crime."

ASP Vuniwaqa has encouraged people who were victimised by teachers to report to police because defilement is a serious crime.

Former middle school teacher arrested on sex abuse charges

A former Augusta County teacher has been arrested in California on charges she had sex with a female student in the late 1990s.

Shelby Sue Shelton, 49, was charged with two counts of carnal knowledge of a minor and two counts of taking indecent liberties with a child. She was in the Sacramento County Jail Friday awaiting extradition to Virginia.

Shelton was a music teacher at Beverley Manor Middle School in the mid-1990s and worked for the Augusta County school system from 1981 until 2000, police said.

The accuser claims Shelton abused her from 1996 to 1998 while she was a student at the middle school until she was a freshman at Buffalo Gap High School. She has since graduated and gone to college, Sheriff Randy Fisher said Friday.

The victim made the allegations in March "because it was the right thing to do and she did not want to see this happen to another child," Fisher said. After leaving Augusta County, Shelton taught music in the San Jose, Calif., school system before going on disability.

I started teaching high-school freshmen three years ago when I was 23. I was closer in age/culture to most of my students than I was to the other teachers. That first year I bonded with a lot of the students; in particular with a small group of boys that were on the basketball team I coached. A couple of these boys developed normal crushes on me-as any horny teenager would have on a mildly attractive female teacher. Since they were 14, I would laugh off their advances by jokingly telling them to "ask again when you're 18."

Well, these boys are now seniors and as their 18th birthdays approach they have taken to reminding me of what I used to say. I know I should laugh off these advances and see the innocent boys that they were instead of the hot men I watched them grow into. But we're talking varsity swimmer and soccer player HOT, Dan. Hot enough to put up with the gossip that would seep through this small town. And it's not just physical attraction-these model-quality guys have killer personalities too.

I have maintained professional and appropriate relationships with these boys over the years. But what about once they're legal and out of school? It seems like 27-year-old men hook up with 18-year-old girls all the time, while middle-aged men drool over the Olsen twins. Why can't I make an 18-year-old's dream come true?

Without a doubt there are lots of reasons I would make a terrible high-school teacher, but high up on the list would be my refusal to play along with our cultural schizophrenia when it comes to attractive 18-year-olds. The same culture that holds up teenagers or might-as-well-be teenagers as the beauty ideal-from Katie "Grin and Bear It" Holmes to Jude "Sexiest Man Alive" Law-penalizes anyone who admits to actually finding hot, legal 18-year-olds attractive. My refusal to pretend that 18-year-olds aren't (1) often hot, and (2) fair game would no doubt cause a scandal at whatever high school was stupid enough to employ me. So it's probably for the best that I'm not a high-school teacher. Instead I have a job that allows me to be honest with my employers about why I took a day off last week to watch 19-year-old Spanish tennis star/superbabe Rafael Nadal win the French Open.

But while I won't condemn you wanting to fuck the living shit out of a pack of totally hot, completely legal, soon-to-be-former students, TT, I don't think you should do it. Here's why: You live in a small town and you like your job. When word gets out-and those boys won't be able to resist telling their friends-your school will find a reason to fire you. School administrators in these litigious times aren't going to look the other way while a teacher bangs her former students. They're going to assume, perhaps rightly, that any teacher banging 18-year-old grads today may be banging 17-year-old juniors a few years down the road. At the very least they'll worry, perhaps rightly, that you invested years in grooming these boys and that you'll set your sights on a fresh crop of 14-year-olds. And if you ever did get caught fucking a 16-year-old current student, your bosses know they'll be fired too if it gets out that they knew you had slept with former students in the past.

Let me make one thing perfectly clear: I think it's totally fine for hot 27-year-old women to sleep with hot 18-year-old guys. If they're old enough to go get limbs blown off in Iraq, they're old enough to get blown stateside. But sleeping with 18-year-old former students carries too many professional risks, TT, for me to give my blessing.

But let's say I got a letter from a 27-year-old high-school teacher who was spending a couple of weeks in, say, Cancun, where she met some recent high-school grads who were totally hot and totally legal and totally not her former students. I would definitely tell that teacher to fuck those boys' brains out-and send me the video-so long as she observed the Campsite Rule. Older folks who mess around with younger folks have a special duty, TT, and it is to leave 'em in better shape than they found 'em. You don't make babies, you don't give 'em diseases, you don't lead 'em to believe that anything lasting is going to come of this. You answer their questions, correct any misconceptions they may have about sex, show them where the clit is, make sure they know that birth control is their job too.

But police are understood not to have pressed charges because the teenager did not complain of any crime. The alleged incident involving teachers from Albany School in Hornchurch, Essex took place a day before the boy's GCSE exams started, it was reported. The Evening Standard said staff and students had been to the Harrow pub to celebrate the end of lessons before going back to a member of staff's house. It was there the teachers and the boy were alleged to have had sex, the newspaper reported. A spokesman for Havering Borough Council said: "Once the London borough of Havering became aware of matters concerning members of staff at one of our schools being involved in inappropriate behaviour outside school hours it acted swiftly to initiate an investigation into those rumours. "Pending the outcome of that investigation, two members of staff have been suspended. "The council will not be able to comment further until those investigations are complete."

Former teacher's aide gets 3 years for sex with students

INVERNESS, Fla. A 36-year-old former Citrus County High School teacher's aide has been sentenced to three years in prison for having sex with two teen boys.

Tammy Huggins also will have serve another 12 years of sex offender probation when she is released from prison. She was sentenced Tuesday after pleading guilty last month to sexual offenses with a victim between the ages of 12 and 15, and sexual battery on a victim age 16 or 17.

Circuit Judge Ric Howard decided not to sentence Huggins to the maximum punishment because the victims were in some regard willing participants, he said, and because she cooperated with investigators and even volunteered that there had been a second victim.

Huggins was arrested in January after investigators accused her of having a sexual relationship with a 15-year-old boy that had begun a month earlier. The teacher's aide also had sex with a 16-year-old boy in April 2004 at a Beverly Hills home.

When the allegations surfaced, she quit her job. She began working for the school district in 2000 and had good job evaluations, according to personnel records.

Huggins' arrest followed the high profile case of Hillsborough County middle-school teacher Debra LaFave, accused of having a sexual relationship with a 14-year-old student. LaFave has another court hearing scheduled later this month.
