Unsolicited Text Messaging
Anyone know what the law says on this one? I've looked online and found some stuff that says it's not legal and that it falls under CANN-SPAM act but the people that are doing it are saying it doesn't. They told me specifically that they have been in contact with the FCC regarding messages they send out and that they are perfectly legal.
Basically the gist is that some club promoter in the area has been sending out unsolicited text messages from from phone number saying to contact him via text on another phone number for free access into some crappy club in the area. I've been bitching about it on my Facebook and Twitter and have discovered about 6 or 7 other people that have also been getting the text messages. I text the guy back once telling him to stop and that he was breaking the law and after a couple messages back and forth he said he was going to remove me, yet the messages continued. I did the same thing again and they continued again. Yesterday I called the "executive office" of the club and spoke with some women about the legalities of their unsolicited spam, and although she agreed with me she wouldn't like to get unsolicited text messages she said she wasn't breaking any laws and that is all that mattered. She said she was going to take me off the list, yet I received another message today. It's just getting really annoying. I almost feel like physically going there and speaking with them, but at the same time I'm thinking about having someone that knows legalese write a sternly worded letter about their actions...

As Lathum suggests, you should be able to contact your phone provider and block that number.
(Thanks for another anecdote to add to my pile in my neverending fight with the university I work for to keep them from going down the unsolicited text route. Administrators are always insisting "Students WANT texts from us about important events." I usually counter with "Define important." They say, "Well, a committee would decide." I say, "Make it opt in." They say, "No one opts in. We'll let them opt out." I say, "You're so stupid your mother should have smothered you right after you were born. Or maybe this is evidence she did, she just wasn't competent enough to do it well.") |

I would contact a lawyer rather than going down to the club. I don't see anyway this would end well with you showing up in person.

I say you start sending him some unsolicited nude pictures of fat men. Or we could just do what stevew says but it should be the number he wants you to call not the one he spams with.

Did you do any business with them recently or sign up for something? My question is, how did they get your number? From my understanding (I could be completely wrong though, so grain of salt taking here), if you've done business with a company, they are allowed to solicit you for a certain amount of time or if you signed up for something and it was in the fine print that by signing up, you agree to let them solicit you.
If you have never done business with them and they got your number from some company that sells peoples cell phone numbers (which I think is against the law), then I'd go after them for that and the company that sold the numbers. I like the idea of carpet bombing their phones though much better.
