Cops Allowed to Destroy an Innocent Man's House and Not Pay for the Damage

Shoplifter in CO flees police and hides in a stranger's house. Cops blow holes in the walls and wreck the inside in an effort to get the shoplifter. The city refuses to pay for the damage. Court agrees that the city owes the homeowner nothing.

Another case where the interpretation of the law may be correct, but the outcome isn't right.

It's odd to me that nowhere in the NPR story on this is there any mention of homeowner's insurance. Shouldn't they be the ones on the hook here?

I know a lot of HOI policies have exclusions for illegal activities...
I think Ive told the story before about the rental house that I rented to a dude who cooked meth..unknowningly and burnt it up.
Insurance said, nope. not our issue. he was committing a crime

In the news story it says insurance paid. The city offered him $5000 to cover his deductible. He refused. Then he built a really nice house.

So insurance did cover the loss.

Where did you see this? In the NPR story the original link referenced I don't see anything about insurance.

This link shows a kind of before and after if you look at the pictures. Without having all the information it does look like the guy maybe decided to build a much nicer home with the expectation/hope he would be getting more money from the city to cover it.

Couldn't tell ya.
It blew up on dude and burned half the trailer down. Then the state police locked the site down as a crime scene investigation for over 6 months. Then local town began fining me for not cleaning it up, 100/day...meanwhile I still want allowed on my property.

The his estranged ex wife sued me...

Finally after 2 years and 10k to my lawyer all charges and fines were dropped, I was allowed to demolish and haul off the house (at my expense) ...any time periods ask me about getting in rental real estate that's my go to story...i still like my rentals but now im wiser.
