:On Wednesday, a federal district court in Los Angeles dismissed Brown's claim against Electronic Arts for the use of his image in its Madden NFL series. Judge Florence Marie-Cooper essentially found that video games are "expressive works, akin to an expressive painting that depicts celebrity athletes of past and present in a realistic sporting environment." Such works are protected by the First Amendment."

This maybe the way to a fully customizable game, now that likeness is protected as art. Judge rules against Jim Brown vs. EA and the NFL. In a backwards way, EA open the door for a fully customizable game with no need for consent from the players or NFL and their is nothing they could do.

Seems kind of lame that a player does not have control over his own likeness. Hmm. The difference, though, is EA has tons of lawyers to keep this working for them; 2K, maybe not so much.

I would also like to add: backbreaker, where are those ladies in your avatar from? Ayayaay! Greazy likey the donkage! :P

That ruling is not going to last long. If video games are works of art, any company can make an NFL game, just like any artist can paint an NFL painting or any songwriter can write an NFL song.

It it does hold up, that would be awesome.

I hate 2k for putting out a half assed game (feature wise) with awesome gameplay.

Yeah I hate them too. It really really really really sucks to be a football video game fan in 2009.
