Yeah, Tebow is fine as long as they didn't pay him, which they didn't.

Yes, I'm sure this has taken such an emotional and physical toll on the "victims." They truly are in my thoughts during such trying times.

I'm surprised it hasn't been brought up before, but I'm pretty confident EA recorded Brad Nessler saying the last names of some popular players while they were still in college (and not common names like "Smith"). Of course, you had to enter the names manually while editing a roster for the name to be heard in-game. And this was before the whole "submit your name to be recorded" request that went out to the gaming community.

Back in the days before shared rosters, I would manually input the names of the top 25 or so players (by overall rating) at the beginning of my first dynasty season, and I was always surprised how many uncommon names had gotten the Nessler treatment.

UPDATE: Just pulled out NCAA 08 (released July 2007), and entered in a few names of top players with less-than-common names going into the 2007 season (McFadden, Slaton, Brohm, Tebow, Booty). I only got the stadium announcer to say "Slaton," but Nessler announced the other four names. Not that EA's trying to hide the fact that top players in the game were based on real-life counterparts, but having Nessler record "Booty" (beside being hilarious) is just one more nail in the coffin for the NCAA in this lawsuit.

While I don't think EA has a leg to stand on in this lawsuit and don't see any way that they won't lose it, what you're mentioning should be perfectly fine. Those are just names. Yes Tebow is a rare name, but it's still just a name so there's nothing wrong with the announcers saying "Tebow" as long as EA doesn't associate the name Tebow with the starting QB for Florida.

That's perfectly legal, but having the starting QB for Michigan (who is nameless and just listed as QB#16) be a black dude from Florida that's 6'0, 195 and is by far the fastest QB in the country is where EA is really, really screwed.
