First, let me apologize for the "partner" comment. I did misread your post.
I have played ESPN 2K4 and ESPN 2K5. Yes, ESPN 2K5 is improved, but it's still the same underlying game with some enhancements here and there. It's the same basic game, just as Madden is the same basic game with some refinements here and there with each new installment. Where's the difference?
My whole point originally was that people bitch how madden is basically the same game year in and year out with nothing more than a roster update. That's entirely untrue. I still stand by my comment that Madden has made more improvements "on the field" from last year than ESPN did. Sure, ESPN toned down their running game, added some nice animations.. but other than that it's mostly presentation enhancements.
Madden redid their playmaker (which btw was terrible in 2004). Allowed for some of the best presnap adjustments that you could ever want to make on Defense, implemented the hit stick (a very underrated feature IMO). You can argue that you can do all the same stuff on Defense w/ 2K5, but a lot of it doesn't work. Can't spy the QB, which allows for them to run like the wind play after play.
In Madden I dare somebody to try and run all game with Vick, McNabb or other speedy QB's because I got something for them. I love playing manual defense in Madden. In ESPN I'm scared to touch a button because I never know what my defender will do. Was exactly the same in 2K4.
As far as being under contract in previous years, it was true. Not every company purchases the license on a year-to-year basis. So whether or not you care to call it "under contract", regardless they were unable to give exclusive rights because more than one company still had the rights through this year.
When it's all said and done, this conversation, arguement or whatever you want to call it is pointless because next year, we as gamers won't even be able to have this conversation, which really sucks.
