IDK about the physics, but to answer your questions...

1) Because, if the prisoner dies and comes back, he is free of all charges unless he had multiple life sentences. Therefore, if the prisoner survives execution but dies later due to an infection, the guard can be charged with manslaughter and the state with recklessness.

2) Because they were dumb enough to to think they would be heroes after their run. They didn't realize they wouldn't be around to enjoy the hoopla, as if any other Japanese cared. That is why Japan is not allowed to have any major armed forces, due to the fact that as far as sheer nastiness they were second to none in wars that they took part in. They would even cover they're bullets and other weapons in feces so that if the target was not killed immediately, an infection would shorty do the trick.

Tbh.. That's what I thought too. I had this game set to all madden, but tweaked with my custom sliders btw. I didn't even finish it, because for whatever reason this particular game had way too many 'scripted like' dropped passes.. And many suspect moments as if to say "you're playing a good team you know, thus we can't allow you to make certain plays." In regards to that glitchy play, I did almost feel as if the A.I. Was trying to say, "FVCK YOU, FIRST DOWN". lol
