Jake Shields was brought over on his existing Elite XC contract that didn't have a championship clause. All fighters who sign a Strikeforce deal have championship clauses.

he could vacate their title and leave. there are ways around a champions clause, just if you take that avenue, dont expect to have that bridge left unburned

Uh no. This isnt boxing where belts are given by governing bodies who have no contractual relationship w/ the boxer. Diaz has a contract with Strikeforce and he would be in the same position that Randy Couture was in a few yrs back. Couture tried to leave the UFC while Heavyweight Champ so that he could take a fight against Fedor. What happened? The UFC sued his *** and he ended up settling by coming back to the UFC and signing a new deal. Even if Diaz sued to get out of the contract, it would take well over a year for his case to be heard and that means a year of no fights.
