There are standards, its called the Uniform Commercial Code, specifically Article 2. So your theory is unknown to the average customer as soon as I enter Dell's, or anyone's website I enter into a contract to honor whatever their site says before purchasing the item?

I'll give you that Dell does list their policy on their website, in fact here it is. I'll also give to the average person it looks scary, but this thing just isn't in accordance with the governing law, unless Dell is based out Louisiana now. Dell denies responsibility for errors made on Dell's site, it begins to fail there and continues to fail as it completely ignores the applicable law. Add to that you don't even encounter this agreement during point of purchase, it doesn't seem to take effect until Dell decides it should. I am telling if you really pressed the issue with Dell and took it to court you would stand a better than 50% chance of winning in almost every state.
