How do you download the patches? Do you need XBOX live?

yes. but you don't need a Gold(paid) account. patches are available to all as long as you have internet access.

Yeah I know that I am connected but I am not recieved the updated. What I am asking is it automatic or do you have to do it manually.............

It is automatic, just sign in and put the game in, it should prompt you from there.
