yeah man, why would they open new copies? I would take the game back and demand one in shrink wrap. sounds like they are trying to rip people off.

I just called the store and they told me the reason mine was already "opened" was that it was their last copy and they apparently gave someone else the VIP code from my copy over the phone? Wow.

You sir are a better man than me, because I would be calling the manager of the store (or somebody above him). I would want either a VIP code or a points card to cover the cost of having to download it from Xbox Live/PSN.

I asked if they had anymore codes and the guy's answer was basically "well the last one we had we took out of your box and sold it to someone over the phone". I told him I was coming in today to return it and he said I could only trade it in since it was already open.

SINCE IT WAS ALREADY OPEN?!?!

Then I did talk to the manager who, after "calmly" explaining to him why I thought that excuse was BS, told me I could come in and get my money back. I now see why people on this board hate on Gamestop so much, this is absolutely ridiculous.

Yup, I just stick with Amazon now and trade in at Gazelle.com since they have pretty decent trade in value with 5% more credit if you ask for an Amazon gift card instead of the other options. MW2 was still $30 and it came out as $31.50, but I also traded in like 10 other games and recieved alot more. Spiderman Web of shadows was $15... I was so surprised at that. They even pay for you to ship and send you a box to put your items in. I was done with GameStop when I didn't see the game on the shelf so I asked if they had anymore copies. They go into the back and find a case open it up and put the disk in and try telling me it's "new".

glad to hear it all worked out for you. I bought a "new" game there once (it had been opened, apparently, to be a shelf copy) and decided to return it the next day because I found a better deal elsewhere. I had all these scenarios running through head about them not wanting to refund my money since it was opened, but it was actually a painless procedure with no hassle.
