    Keller Lawsuit On ESPN OTL

    I saw a story of the Keller lawsuit against EA Sports and the NCAA on Outside the Lines. I hate to say it but the suit holds some water. Hopefully it won't impact future iterations of NCAA.

    I am going to buy a used copy of NCAA 10 (took my original back on trade in) and get hooked again just in case EA Locker and real numbers can no longer be utilized....

    Wow. I'm speechless. I guarentee the money that WOULD have been invested into this game (pfft yeah right) goes to the lawyers for paying their legal bill. If this games goes under I will lose my gord.

      I wouldn't worry about it. The game will remain the same, even if they lose this lawsuit, which they won't. All these clowns are looking for is to make a little bank off this. IMO.

        if anything, it'll just make EA make the default roster more random that it already is. I don't see why it'll make them stop the roster sharing feature. if that somehow breaks the law, then pretty much every game that has sharing of custom content will have to be banned/changed.

          Considering Tyler Hansbrough's likeness in last year's NCAA basketball game I think EA is going to be safe. (Looked like a 6'9'' Nick Nulty with a perm).

            Based on the information in the story, EA went to great lengths to include a player's hometown, height, weight, race and accessories. They are also piling on with ratings. It doesn't have to be specific names to be considered "likeness". Based on the story it could be an interesting case.

            I have no issues with generic rosters as long as EA Locker stays in tact. Even so, gameplay is all that really matters....

                This year pre-patch, well sorta post-patch too. But from editing the cougars I have noticed they have the hometowns and everything correct which isnt going to help EA's case.

                  seriously, the guys a freakin bar tender at a night club; really living the dream man. sorry you got beat out at arizona state, then went and sucked *** at nebraska. oh and as far as the whole "im doin this for ALL the athletes that have had their rights violated," cut the horse ****. all of those other athletes dont care, which is why there hasnt been a lawsuit until your bitchass decided to try and make a quick buck. i cant say enough about how much i dislike this guy

                      If the NCAA loses this Lawsuit, it will have far reaching impications as far as NCAA Sports goes.

                        What little I've heard about the suit seems to me like it is sound. Keller's personality issues aside, it is ridiculous that these kids have their likenesses in a video game including name, ratings, background information, and even realistic player models. And yet they make nothing for it.

                        I always felt universities selling jerseys with a kid's name on it and keeping 100% of the profit crossed the line. But one could argue that was part of the "agreement" the athletes signed when they came to play there...we give you a scholarship, and you whore yourself out for four years to make us rich.

                        But when an outside entity like EA gets involved, I think it is utter horse sh*t that these kids don't get compensation. If I created a game and created an exact likeness of some random kid on a college campus, and used his name, he'd be able to rightfully sue.

                          EA doesnt include players names in the game nor do schools sell jerseys with names on them.

                            I am studying to be a lawyer so I have a little experience in his....GRANTED, I would in NO WAY say I am an expert or even prepared to handle the suit. However, based on my knowledge, the lawsuit is more than legitimate, I fear we may have seen the end of player likenesses in college sports games

                              I watched this and laughed the whole time. This was part of a series that OTL is doing on the bussiness side of college football. I don't know what Kellers scholarship said but the one I signed said I would get a free education, books, room & board for me playing a sport. That was my pay. I got something that would have cost me over $60K. Keller got a chance at a degree. He could have got one in anything the school offered. It is not EA or the NCAA's fault he has to tend bar. His lawyer was a winner. This guy is just looking for a case to get his name out there so he can become a national name. If he could win a case like this then he would be on his way. I don't see this going anywhere though. The NCAA gave EA the ok to do what they do so if anyone was in the wrong it would be the NCAA. They both have lawyers working for them telling them what they can do and keeping them in the clear. The fact that EA has put the game out for years and no one has done anything would lead me to believe that this will go nowhere.
