NBA 2K16 Dynamic Team Creator - Ability to Create Custom Colleges in MyCareer?

Leaked today were descriptions of NBA 2K16's Game Modes. In the MyTeam section, it announces a new "Dynamic Team Creator" where you create every element of your team's appearance, team logo, team uniform, and team arena.

Now this Dynamic Team Creator seems to be cross-referenced into other game modes, namely MyGM and MyLEAGUE as you can relocate your franchise to other areas.

With 2K's PRO-AM, it talks about "Fully customized branding." Hinting at a uniform and logo creator that you can use for your team.

Why couldn't 2k implement this "Dynamic Team Creator" in the start of MyCareer when selecting your college?

For example I select Create a College, I name my college "Iowa Hawkeyes". I select the city to be Iowa City, IA. I set their home uniforms to be white/yellow, and set their away uniforms to be black/yellow. Then with their logo creator (think Call of Duty's dynamic logo creator), I recreate the Hawkeye logo.

It's the perfect loophole as the user is the one creating it. Think about the ability to share your college on 2KShare?

On 2KShare, you have the ability to download user-created draft classes. I can download the 2016 draft class with real life names and likeness of College players right now. 2K never got in trouble with that as the user is the one that creates it.

This won't happen because these colleges will go after 2K in .000000000000000000000000000000001 seconds. The O'Bannon case stated that EA was at fault because they allowed roster makers to easily replicate player likenesses and share them over a roster vault. And if you get 110 colleges created and shared over 2kshare, 2K is asking to lose money because of that judgement in O'Bannon case.

        Source?

EA was at fault because "agreed to be the lead plaintiff after seeing his likeness from the 1995 championship team used in a video game without his permission.[7] The game featured a UCLA player who played O'Bannon's power forward position, while also matching his height, weight, bald head, skin tone, No. 31 jersey, and left-handed shot."

2K allows you to download College players right now as a draft class. Hell people were still creating rosters for College Hoops 2K8 and sharing them on Roster Share until a couple years ago when 2K shut down the servers.

I sat there and read the whole judgement handed down by the judge a couple days after the settlement was reached.

Here's the full 99 page document. A quick search of "share", "roster", "download", and "name" brings up absolutely nothing about EA's Roster share.

The whole thing is about the likeliness of the players.

Also interestingly enough, All-Pro Football 2k8 had a Dynamic Team Creator where people created NFL Teams, with their official logo and everything. Again, the user creates it. Not 2K.

I understand what you're getting at; it's a legitimate argument and debate but there may be a few problems with what you're asking for.

First, I think the "Dynamic Team Creator" idea can gain weight but I'm unsure of the validity that it will happen. Since this is my first post, I can't post links but I'd ask that you research when the SEC, Big Ten, and Pac-12 agreed they'd decline further licensure of their trademarks with EA etc. going forward, citing the Ed O'Bannon case as precedence. This opened up the door for individual schools, however, to individually license ie. why you see those 10+ schools we've seen leaked thus far as being in the game. The NCAA has nothing to do with it, they went through the Collegiate Licensing Company and individual schools.

This leaves the door open for schools that didn't give permission or license to 2k to get mad over something as small as letting users create a team likeness into a game. I'm with you, it's dumb someone would get mad over that, but look at situations such as the UFC getting upset when EA MMA (they were licensed with Strikeforce at the time) allowed users to create guys like Anderson Silva and share. If I remember correctly, they started flagging that content and it was only available to use offline.

Re: NBA 2K16 Dynamic Team Creator - Ability to Create Custom Colleges in MyCareer?

Secondly, user-created content is tricky. From what I've read, the reason we're able to create draft classes via 2K share is because the created players have no affiliation with a collegiate team outside of the box "What College Did You Play For."

I have no clue why they allowed those user-generated content in All-Pro, maybe the NFL just didn't care, especially generated as much money as they did this year. But all it takes is one person, former or current player, etc. to say something and we'll have a new legal issue. The Ed O'Bannon case has set a big precedence as to how things will be handled going forward, so I think 2k may be taking the cautious steps until this whole process (including the forthcoming appeal) passes over. This is just the first iteration, so maybe more is coming in the future as to what they'll allow us to do.

This is incorrect. EA got in trouble because they used Ed O'Bannon and all his buddies in the game without their permission. Heck, they literally made Tim Tebow as a #15 for Florida with the same height/weight/attributes. THAT is what got EA in trouble.

2k cannot be legally reprimanded for user created content. Had EA just made every player randomly generated and gave the users the ability to edit every player in the game, they wouldn't have had any problems. However, they created nearly every single player on each team but just didn't include his name. You could literally take a team roster and go down the depth chart in NCAA Football and just plug in names and it'd be 90% accurate.

Yea, I think that's why the NCAA backed away from EA in that regard. They blatantly left no question unturned about who was who in the game. They'd have small variances, maybe the guy had dreads and didn't have dreads in real life but pretty much everything else was directly correlated to the actual player.

User created content is one of those blurred lines but if done right, there should be no problem whatsoever.

Looking more and more likely after 2K's Pro-Am Team/Jersey/Court Creator that got released yesterday.
