Involves both misdeamonr and felony. He's on probation already, not sure this helps his cause any.

I have no doubts he'll be charged.

He was apparently booked at 2:34 am and released a little after 6:00 am which tells me he wasn't all that drunk. I am betting the charge gets reduced.

Doesn't excuse it, and I believe this would be his 2nd, so he may have a problem. I am sure the commish will weigh in on this as well.

Yeah, he was on probation for a prior DUI already.

The reason he thinks he won't get charged, and that it's considered a misdemeanor, is that (according to NFL.com) he failed a field sobriety test, but his blood alcohol level was never taken. If that's true, I understand why it's a misdemeanor, and with the lawyers he could afford, I wouldn't be surprised if he plead not guilty, and gets the charges dropped.

That being said, this is still a really stupid move, at the worst possible time.

IF those are the facts, that's why he thinks he can get off. The officer said he was swerving all over the place, and that's why he stopped him. Last I checked though, you can't be convicted of a crime just because someone said you committed it.
