Bottomline as a grown up it's on you to figure out weither a person is of age or not. Fair or not right or wrong this is the law and he knows it. So by the letter of the law if he had sex with her he's guilty.

Exactly. You should know the age of the person you are going to be having sex with. If you can't trust that person when they tell you, then should you really be having sex with them? If they lie about their age, they could just as easily lie about having herpes or HIV.
