Team Builder: A lawsuit waiting to happen?
I just checked out the team builder website and think EA did a great job with it. But the lawyer in me thinks it's a lawsuit waiting to happen. It will be interesting to see how long it takes for the first lawsuit to be filed. There's some money to be made there for a good plaintiff's attorney, IMHO.Tags: None -

How is this a lawsuit ready to happen. This teambuilder idea is not breaking any laws. IF you are such a laywer type guy. Please tell us how this is a lawsuit ready to happen.

how is it a lawsuit waiting to be happened? Its just a CAS, its up to the user to decide who they make. People aren't making money off of just creating a team.Comment

Presumably, EA has permission to use the FBS and FCS logos and jerseys, since they are included on the TeamBuilder site.
Also, I assume that EA has some sort of moderation system in place for logos that blatantly infringe major copyright or are offensive.
Finally, I don't see how EA can be held responsible for any user-created content; though they are allowing flexibility in the game, they are not directly responsible for putting a Pepsi logo as a user TeamBuilder team's logo (a ridiculous example, but best I could think of).
I don't see how any lawsuit would stick.Comment

EA most certainly can be sued for hosting copyrighted images and allowing the downloading of them. Do you not remember what happen to youtube? Most likely what will happen is that EA will remove anything that the copyright holder complains and then maybe block the user who created it. As long as EA is removing them at the request of copyright holders, then they should stay out of trouble. EA can say they have no control over what the users put up, but they do have terms and conditions that probably say you can't infringe on copyrighted images.Comment

The only way this would be a lawsuit waiting to happen is if they were allowing us to put the logos of Nike, Rebook, etc on the custom uni's that are created. From the looks of it, even if you pick a pre-existing uni and modify it slightly, the maker logo goes away. Other than that, it should be ok.Comment

Considering that EA is making money off of the likenesses of collegiate athletes without paying them then yes, I'd say they have some fairly stupid lawyers.Comment

Exactly.
Someone didn't think this the whole way through. At the least, someone greenlighted this feature BEFORE the latest lawsuit was filed against the NCAA and EA.
And for the record, EA's lawyers can lose just as easily as anyone elses. Ask the NFLPA (following the $28 million judgment against it) how much it means to have the best lawyers money can buy.Comment
