Court Greenlights Class-Action Suit Against EA for NFL Exclusivity
Doubtful that this will amount to much. But, maybe it's a glimmer of hope for seeing a new 2K football game. I'm not a Madden *****, but you have to admit competition generally makes for better games by both sides.

After reading that article, I honestly think that EA is in huge trouble of losing the class action suit because if there wasnt a damn good case against them, the judge never would have greenlighted the case.
And while this should be in the other topic, im going to post it here -
ESPN NFL 2K5 did in fact kick EA's *** because EA lowered all their games from $60 to $30 only three months after Madden was released despite the fact that it normally took EA almost a year to actually lower their sports titles. Amazing how the NFL didnt think that EA cutting the price in half three months later didnt cheapen the NFL brand.
I love how EA not only purchased the exclusive rights to the NFL but also the NCAA, AFL and ESPN licenses as well. Sorry but if the EA/NFL deal wasnt the start of the biggest ******* screwjob in sports video game history, I dont know what is. -

I don't think it will fly. If it does then they'll have to address all of the exclusivity of other products connected with varying sports: Gatorade, Snickers, whatever.
Not that I care. Personally, I can do without potential commercials saying things like, "Viagra! The Official Male Enhancement Product for the United States Pole Vaulting Team"Comment

Because EA hasnt done a damn thing to improve their product in the last half decade plus when EA dropped the price of 2005 to $30, they went back to $60 with 2006 because they had no competition and thus, could jack the price back up.Comment

And I honestly think that there's an excellent chance of EA losing because the case wouldnt have been given the okay to go forward and because the lawfirm has actually won some huge cases.
If EA loses, everything changes.Comment

There's a difference there bud. You can still go out and buy other drinks and candy bars because you have plenty of options. In regards to the EA/NFL deal, you cant go out and buy any other football game except Madden and thats where the difference is.
And I honestly think that there's an excellent chance of EA losing because the case wouldnt have been given the okay to go forward and because the lawfirm has actually won some huge cases.
If EA loses, everything changes.
But, hey, you don't want single provision for any particular product or service?? Hmmmm.... that's good..... just keep that attitude in mind in a broader perspective.... if you catch my drift!Comment

EA approached the NFL first a couple years prior ( once they realized they screwed themselves by not releasing their sports titles on the DC which lead the the birth of 2K ) and for whatever reason the NFL waited before deciding 400m is to good to pass up.Comment

If the courts can keep big pockets out of this and go strictly by the law, which this law firm has noted that EA is in violation of the Sherman Act or "Antitrust Act, then EA can be in a little bit of trouble. This law is geared more to protecting the consumers rather than EA, 2k, or any other former football video game makers. I wish this would hit the airwaves because they love to talk about unfair market practices. Go read the act an you will see why the judge ruled four counts against the gaming company can move forward including violation of the Sherman Act, violations of California's Cartwright Act, violation of California's unfair competition act and unjust enrichment.Comment

Every game sells for $59.99 now, as the whole industry made the same $10 jump up from $49.99 last gen. EA never jumped Madden's price up to some obscene amount. 2k's price was a marketing gimmick to get some attention. Not only did NHL 2k5 and NBA 2k5 carry the same $19.99 price, but they returned to the standard $49.99 price the following year. That was even the price they sold games at years prior on the the Dreamcast. 2k even referred to raising the price of NFL2k back up in a similar fashion.
Take-Two pres and Visual Concepts' senior marketing veep explain the strategy behind the game's low $19.99 price tag.
GS: What happens when the next-gen consoles appear? Does pricing remain the same or do you bump it back?
PE: Once the average sports fan, or even the casual sports fan, has the great gaming experience--and has played this game for many hours, and talks about it, and realizes the whole gaming experience--I think we will have the ability to move the pricing up.

This statement gets dumber and dumber everytime I see it. Madden was already outselling 2k5 4 to 1 when EA cut the price in half Dan. They cut it because it was the holliday season Dan,not because 2k5 was putting a dent into anything.
But I guess if you tell yourself something long enough,or listen to the same thing long enough then I guess you start to believe it. I mean,if it's on the internet it must be true.Comment
