It doesn't look good. The only positive note here is that EA was willing to make allowances for the players, which means that they'd be OK with that in the future.... assuming they don't get killed in the present with damages. The NCAA better come up with something better than, "I know that the players in the game look exactly like who the real players are, but it's completely a coincidence" defense, which is a sure loser. At the very least, EA should be arguing first amendment. A lawsuit by Jim Brown against a gaming company was successfully defended that way. Of course, they'd look silly now, but this current defense isn't going to fly one bit.In August 2007, when licensing of video games was being negotiated, EA allegedly "offered to establish a 'players' fund' for the use of the (student-athletes') names, images, and likenesses. CLC, negotiating on the NCAA's behalf, instead suggested that the money should go to the NCAA. EA agreed to pay a kicker to the NCAA in order 'to align interests and incentivize all parties to help build the category with new rights.' EA should just settle out of court, pay the damages and separate from the corrupt NCAA for good. Make deals with individual colleges with the Collegiate Licensing Compact.Comment

It's not the colleges that are the problem, it's the players. It's clear that EA has no problem paying them, but the current rules prohibit them from being paid, even though those rules might be ruled retroactively illegal in the future. That's the problem. As a company, how do you manage such an impossible situation. No article has suggested what to do about that. Maybe they could put some money in escrow or something... I don't know.Comment

I'm thinking they should make like a superfund, like donate maybe 10 percent of their profits each year to a fund that athletes who don't make the pros can get a cut of. I'm a bit confused in the other thread from what I read was that the CLC was not part of the lawsuit so they would be able to agree with EA to continue the CFB series but this article states that the CLC is part of the lawsuitI know it's late but this is #1 on ESPN headlines

No offense but outside of physical statistics the players don't look like their real life counterparts, especially when it comes to the faces which largely look ridculious.
To be honest, this probably helps EA more than it hurts them, but it hurts the NCAA who says no to paying the athletes and told EA to just give them the funds that were allotted to the players which in all liklihood turned into bonuses for the upper echelon.Bulls|Bears|Cubs| Blackhawks|Huskies|Horned Frogs|

I agree all the players pictures now look like cartoon characters. Just sad they want to ruin it for us. Yet they got a scholarship to play football which equates to a free education. And even the ones that didn't get a scholarship they still got to play college football.No offense but outside of physical statistics the players don't look like their real life counterparts, especially when it comes to the faces which largely look ridculious.

If EA is smart, they will be proactive in the future and go out of their way to use player numbers and attributes. It will mean a lot of work to put together realistic rosters on the user end but I'd rather that than have nothing.I know it's late but this is #1 on ESPN headlines

On a side note - if anything, EA will save 540,000/year by not having to pay for the "NCAA" part in their football games. Who cares if "NCAA" is in the game......the only other worry would be the licensing by individual schools.Comment

I absolutely agree with you. People understate what a degree does if they actually devote time to a field they are interested in and don't go for a basic degree to breeze through school.I agree all the players pictures now look like cartoon characters. I'm on your side as far as the lawsuit and degree thing goes, and I hate to be the "well...actually" guy, but Ed O'Bannon was far from a scrub when he was in school.

No worries man. I hated even bringing it up. I don't like being "that guy." I especially agree with what you said about degrees and all that.
I DO feel that the NCAA still needs to improve some ways that they treat ALL players, but this isn't the place to comment/debate that.
I really don't care for UCLA. I HATE Ed O'Bannon (for obvious reasons.) But just wanted to point out, dude was no scrub.
It's weird to root for EA as a company in anything, but I would really hate to see college football games disappear.
I don't understand why EA didn't start completely randomizing numbers, race, heights, and weights...and then allow us to edit ALL teams' rosters online via a process like TeamBuilder. It would be SO much faster, and would allow for super accurate, USER made rosters available on the game's launch day. I feel it's probably too late for this kind of option now. Maybe not. It seems like it could solve a lot of problems though.
But now...who knows now. What if EA makes a college football game and the whole Big 10 decides they want a super large amount of money? Or Notre Dame? Will you just leave them out? (Think College Hoops and their fake schools). Or what if it's just one school in one conference? What then?
EA doesn't care about bringing joy to consumers through college football games. It cares about profit. If a college football game proves to be too big of a challenge to be profitable (or if the profit barely exceeds licensing costs)...then you can probably chalk up college football games as things of the past.
It's a shame really. I guess Ed O'Bannon, Sam Keller, and the like aren't gamers. I'm a little worried this may be the beginning of the end of the college football video game. I really, really hope I'm wrong though.Comment
