    Refund Denials for Digital Buyers

    Hi Everyone,

After yesterday's issues/delay with MLB's digital version, I opted to cancel, get a refund from Sony and went out and purchased a physical copy of the disc. Earlier today, I received an e-mail from Sony denying my refund with a reference number and suggest to contact sony if I have any questions. Well, I contacted them and they refuse to give me an opportunity to speak to the people processing these refunds.

Long story short, I am looking to get in touch with anyone who attempted to get a refund yesterday and either failed to get one or was promised a refund that was later denied. I am a law student with plenty of time on his hands and I am considering starting a class action suit against Sony to reimburse those of us to whom they failed to deliver their product to.

    See the e-mail below:

Thank you for your recent call to Sony Computer Entertainment America (SCEA) Consumer Services.

We are unable to process your request for a refund on the PlayStation&regNetwork.

According to our Terms of Service, all sales are final.

For more information please check the Terms of Service and User Agreement.

Yep we were trying to tell people that you were not guaranteed a refund. They simply was just opening a case for you that would be reviewed.
It’s easier to do the right thing, than to explain why you didn’t.

This is why I just sucked it up and waited for it to be ready. Although I saw a lot of people with screen shots showing an online rep granting them a refund and saying it would take 5 business days for the funds to be returned. Sounds like Sony knew what was going on and wanted to double dip here. Pretty gutless.

It has nothing to do with sony screwing people over. Things happen. It was delayed. Im fairly certain it says somewhere in the ToS that no one ever reads that all sales are final. All the reps can do is request a refund. They cant actually give one. If people had more patients they wouldnt be out 60 bucks now.

Sorry, but just because you say "all sales are final" does not mean it is a legally sustainable term in a contract. You actually have to deliver a product or service for the sale to be complete.

I completely agree with you, and it does say that they can not even be cancelled before you finalize your order, I only read ToS when money is involved. And you're right now that I look the rep was saying they can help them get a refund and will open a case. Lesson here, if you can't handle bumps like this don't buy digital copies anymore as it's bound to happen again. Go stand in front of gamestop for 10 minutes and sell your physical copy to someone for a $10 discount, I'm sure someone will be going in to buy the game anyway.

Its been delivered. Late but its been delivered. I actually hoped they would refund you guys but I knew it was a slim chance. This has happened before.

I won't put my head in the sand, It was a first and I learned a lot. From now on, it's going to be hard copy no matter what. It's not the end of the world, it's just a game.

Imo what this shows is Sony needs to improve the crappy refund process. They should be able to refund pre orders barring the game has not been downloaded on the account. They should have issued those refunds. Unfortunately they have a anti consumer policy in place.

It clearly states all purchases are final. The game came out AFTER 12.01 on the day it was supposed too.

Best of luck winning any case against them.

This is the problem with the world of today.... Can't get your own way... Sue

Nobody is actually going to sue. Not worth the money it would take to do so, even before lawyers fees, and there is no real remedy to be sought.

It hard to feel any sympathy for those who jump the gun on buying a physical disk because they couldn't wait 14 hours. You accepted and the terms and condition when you buy a digital copy of the game.

I agree totally, but like I said, there's no way I will ever go digital way. The day it's the only option, I'm going to do something else if I don't have cancelling order until downloading the game.
