Yes you are still protected and can open a dispute. But if you gift the money instead of sending it as merchandise received then you are not protected under pay pal policies. Couple years ago a guy tried to stiff me on black ops 2 after I sent him the money for an early copy. Opened a dispute, the money was frozen until a resolution was made. Got my money back.
