Here is the blurb from Gamespot and how they descibe it.

ESPN Videogames is supported by an advertising campaign that airs commercials on the network.
However, there is no contractual agreement that prevents video games from publishers other than Sega from being featured in commercial ads on ESPN.

Yep..they (ESPN) are honoring their agreement but are making money from EA also, as is their right. I DO find it intersting that according to this ESPN IS supporting the commercial effort on the air.
they had better kick that up a notch.
