California Recall Election Back On... Again

http://msnbc.com/news/945950.asp?0cv=CB10

Breaking news... this is all I could find:

Quote:
SAN FRANCISCO, Sept. 23 — A federal appeals court decided Tuesday that California’s gubernatorial election should be held on Oct. 7 as originally planned, giving Gov. Gray Davis and the corps of candidates seeking to replace him two more weeks to try to sway voters. It was not immediately clear whether groups that sought the delay would appeal to the U.S. Supreme Court.

Saw this one coming when the full eleven agreed to review the judgement. Not in the mood to be overturned by the SC (again).

Agreed. And I don't think the Supreme Court will touch this one if there's an appeal now.

Hehe

No chance they'd give it a second glance.

Part of me sort of hoped that the panel would uphold the initial ruling. I really wanted the Supreme court to Spank the 9th court. Those three judges wanted to wage a PR war. They wanted to get the Supreme court to over rule them. They were hoping to present the illusion to uninformed members of the public, that the Supreme court was making decisions based purely on Idealogical lines. Some media and Blog folks were already jumping on that bandwagon. The problem was...."This was a far cry from the Florida case".

The biggest difference, and this is something I learned while listening to the oral arguments, was that the California legislature has actually passed a law defining set of uniform rules addressing both "undervotes" and "overvotes" during a recount. I was actually critical of the legislature when the 9th circuit initially ruled, saying that if the state legislature had done their jobs, this wouldn't even be an issue. I was wrong, apparently the 9th court didn't allow reason into their reasoning.

Interesting side note - I read that Darrell Issa, who bankrolled the recall effort in the first place, is now saying that if both Schwarzenegger and McClintock stay in the race, he will be urging a "No" vote on the recall to prevent a Bustamante victory. That has to be the weirdest turn of events yet.

Does anybody outside of California care about this anymore?

I don't think the people IN really care about it anymore. I'm one of them... and I'm keenly aware that no matter who gets elected out here, it's still going to be like living in a communist state.
