Saw this one coming when the full eleven agreed to review the judgement. Not in the mood to be overturned by the SC (again).

Agreed. And I don't think the Supreme Court will touch this one if there's an appeal now.

I was actually critical of the legislature when the 9th circuit initially ruled, saying that if the state legislature had done their jobs, this wouldn't even be an issue. I was wrong, apparently the 9th court didn't allow reason into their reasoning. |

Interesting side note - I read that Darrell Issa, who bankrolled the recall effort in the first place, is now saying that if both Schwarzenegger and McClintock stay in the race, he will be urging a "No" vote on the recall to prevent a Bustamante victory. That has to be the weirdest turn of events yet.
