This is one of those things I wonder about with TikTok/Instagram/Youtube creators. When you travel in the US creating paid content, is that "work?" I mean, in his case he may have made a paid appearance, and that almost certainly would be considered work. But like the people coming from Europe that tour restaurants and vacation spots to post online, is that "work"? Same for Americans touring other countries.

That would be a real feat; from what I've read ICE was tipped off by a conservative influencer and best bud of Barron Trump, and the guy is rather proud of having done so.

I sent a quick text to the family immigration lawyer chat(three lawyers and me always seeking free answers to immigration questions).

"Short answer. In the U.S., work is a service or labor that a person received compensation for including money, food, or clothing."

I also described what you said. "Paid appearances, duh. Touring restaurants etc. blurry but my initial argument would require proof of intent/execution of payment."

Just go around ramming cars, it's cool.

"A few minutes ago, a vehicle of three people was rammed by a truck belonging to federal immigration authorities in Boyle Heights, CA. According to security footage shown to me, they deployed chemical munitions & detained the driver at gunpoint. All are US citizens according to the wife."

Maybe I'm just stupid, but how is someone supposed to distinguish this from a carjacking?

We need more information

In this case I’m certain that this is actually the second stop

The first one happened somewhere else where they were given an opportunity to show their papers but instead chose to run

It’s really hard to see while driving through a mask. I love my public servants providing public services that they need to wear masks to avoid the public backlash associated with said service. Pretty normal.

Here is the response:
"The Department of Homeland Security has released a statement regarding the arrest, which states that the man they took into custody is accused of “punching a CBD officer,” during protests in Paramount, CA.

They have provided a name but no evidence as of yet. I’ll follow up."

re: the whole social media influencer thing

Weirdly, I just happened to end up knee deep in going through various Visa rules from a variety of nations on three continents (was helping a friend with some of their work, just helping with fact finding) The details vary, by nation, but generally speaking most had restrictions on work-related activities while traveling under the fairly broad amount of short visa waivers. Some were more lenient than others (allowing meetings with an existing employer/business relationship for example) but others were pretty tight.

In one case, there were nine pages of pretty minute details about that very thing.

Since the travelers were North American heading elsewhere, I didn't look at what the U.S. rules are (i.e. they weren't coming here) but I'm just commenting that pretty strict limits on that sort of thing aren't particularly unusual.

I can imagine it is not, and for a couple of reasons. One, the "don't take work from locals", which is the reason that is the most common. Second, the tax-dodge reason. They are earning money there and likely not reporting it. We talked earlier in the tread about the US crackdown on comic writers/artist coming over for conventions. In the past they were allowed without much scrutiny, but they are now being stopped and sent back. So far, though, I;m still seeing regular post from people from England coming over and making paid TikToks and such. I wonder when that might get a crackdown, if it already hasn't in some cases.

The story seems to be that Barron Trump's friend is the one who brought attention to the guy visiting the country and wanted him gone. I dont think he's even a political TikTok guy and his gimmick is not even talking. Seems like his skin color played a role there.

Never seen this enforced before. Kind of a weird spot with technology when checking your work email on vacation can mean deportation I guess.

Here is the video of Brad Landers, NYC Comptroller and mayoral candidate, getting arrested by ICE agents as he try to prevent someone getting arrested leaving a courthouse. The rumor is he is going to be charged with assault on an officer. Now, they have him on obstruction all day long. He was definitely getting in the way of the arrest (without going into whether the arrest is legal or not). But I fail to see any assault here. Maybe possibily he pushed one the guys that were pulling on him? I have looked at it in different angles and if he did it is very hard to make out.

I'll let the attorneys here chime in but pretty sure in the YT police videos I've seen, touching a police officer doing his duty is considered an assault e.g. drunk or "distressed" passenger at airport. Obviously, the LEO makes a judgement call, but in those videos the situation has already gone beyond a calm conversation.

Take it FWIW

Just a moment...
Quote:
18 U.S.C. 111 details three specific types of assault against a federal officer, along with the associated charges and penalties.

Simple assault involves forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers in performing their duties or as a result of their duties.

Penalties for Assault on a Federal Officer
As noted, no physical contact or injury must occur for you to be charged with or convicted of this crime. Simple federal assault is a Class A misdemeanor punishable by up to 1 year in jail and fines up to $100,000.

LEOs should have to identify themselves and show ID before things like obstruction come into play. Especially LEOs who are doing their best to conceal their identities. With exceptions for obviously exigent circumstances, of course. Otherwise we're just legalizing the gestapo.

Wasn't ICE, was Customs (per DHS)

But it lets me cut my last remaining tie to MLB this way so that's kind of a personal win.

But I'll still lmao when MLB gets a much closer inspection of their anti-trust exemption over the next year or so.

Such a handy little benefit, be a shame if something ... happened to it.

That’s great. We would try to explain why law enforcement who can’t be identified are bad to you but unfortunately the stores are closed and we don’t have a crayon.

Some speculation as to why ...
  • He didn't come in under visa waiver, he came in under an actual visa with < 90 days
  • He was working while in the US without the appropriate visa e.g. can't work under visa waiver
  • He did come under visa waiver but Immigration has discretion to reduce from the 90 days
  • His passport was going to expire and when entering, Immigration gave him less than 90 days (think this is less likely)

Went googling to see if there was more info. And no, didn't find anything more recent.

No corrections on him "overstaying his visa" and nothing from his team about being treated unfairly. My guess is 1st bullet and he just overstayed.

Don't know if you've suffered a head injury or your meds are out of whack or what, but enough is enough. It's a sad sight to see someone that used to be fairly okay to turn into such a complete sack of shit ... but that's life.

I like how racists say immigrants should come here the right way... So they mean immigrants need to come here and kill the natives and import their own beliefs... Which is what they claim the immigrants are doing... So I guess I don't see their complaints.

I used to do that to my Spanish textbook in HS -- I'd use my eraser to make people in the black and white illustrations/photos bald.

Karma soon enough got back at me.

More likely reason ... questioned in secondary (no, not fascism, happens all the time pre-Trump), acted suspicious, CBP looked in phone, came out that he lied about past drug use etc. or some variation of that.

Quote:
US Customs and Border Protection (CBP) stated that a Norwegian traveler, 'Mads Mikkelsen, was turned away at Newark Liberty International Airport because he admitted to drug use, and not because agents discovered a meme mocking Vice President JD Vance on his phone. This is contrary to the claims made by the tourist.

I am sure there are legit outrage cases of these western tourists being denied entry, but this (and the others like the Canadian tattoo artist, German kid, French researcher) previously posted here is not one of them.

It isn't.

Or, it happened as the guy said, and CBP is never going to say it did. They have the force of the government behind them, and he's just a tourist from Norway. The power comparisons make waving the entire thing away far too simple.
