Normal transition of power. He meets with Biden, stays until 1/20, comes to inauguration, etc. 5 5.56%
He doesn't fight the result, but resigns prior to the inauguration. 2 2.22%
He fights the result but gives up shortly before the inauguration (let's define "shortly" as "some time after the EC meets on 12/14") 30 33.33%
He fights the result all the way to January 20th. Has to be physically removed. 12 13.33%
He fights the result for a short time, but gives up and resigns before the inauguration 6 6.67%

PA certifies tonight. That puts Biden at 289, leaving AZ and NV as the only "contested" states not certified. By all logic, it's over. But by all logic, it was over by around November 6th, and that hasn't stopped Team Trump from this nonsense up to now.

NYT reporters saying that Trump kind of went all-in on Rudy and his conspiracy theories. After the Pennsylvania debacle, he realized that Rudy doesn't know what the fuck he is talking about.

There is also mention of them asking secret service agents if they would like to move to Florida. As well as some changes to Mar-a-Lago. A sign he is setting up his post-presidency residence.

If so, that would mean he's arrogant enough to think he can remain in the US and avoid legal troubles. I'm honestly not sure if I think that's a good thing. It probably is, but if he did leave that's a mess that would be avoided.

It appears with GSA approving the transition going forward a lot of folks on Facebook are finally accepting things.

Of course you have a bunch of conservatives saying how sad they are that Americans chose socialism... Calling Biden socialist is just guaranteed to have the term be far less powerful of a scare tactic for the younger generation.

Let me recommend the latest Hell & High Water podcast. Hell & High Water with John Heilemann on Stitcher



Two legal experts talking about the attempted coup, why it failed (at least to this point), and how it showed a weakness in our Democracy. What I found most interesting was the description of the debate about what powers the State legislatures have. Basically the disagreement comes from Rehnquist's concurrence in Bush V. Gore that quotes from a Senate report from the late 19th century that says the legislature has almost a super authority to select delegates that goes beyond even their own states constitution. It was from this that Steve Bannon and Rudy Giuliani started in September to move the President toward this idea that he could use Republican state legislatures to supersede the election.

The problem with that plan (other than they couldn't get those legislatures to play along) is two fold: First, the constitution does not give the legislatures the right to pick the electors. It gives the right to pick the manner in which the electors are chosen. The Constitution could have left it to the legislatures like it did with Senators, but used expressly different language in this article. Secondly, the Constitution clearly gives US congress the responsibility to set date in which the electors are chosen, and that date has to be the same for the whole country. So if the legislatures decided after the election to change the way of selecting, it would be too late.

It feels better to hear the actual arguments, even if that doesn't mean the Supreme Court might ignore them.
It makes it extremely difficult to see how, though.

I agree, and think it is funny. BUT, I do see one way it could suck. By law, the winner must break 50% to win. So even if Warnock or Ossoff wins, they have to break 50%. I would prefer there not be a third run off, and I could see the race being close enough for that to happen. I liked the idea of Trumpsters boycotting the election better.

I would think that write-ins aren't allowed in a runoff, otherwise you could theoretically just have endless runoffs.

Write-ins make zero sense in a runoff. The whole purpose of a runoff is to decide between the two final candidates.

We can hope, but I just looked at my sample ballot. There is nowhere to write-in. I guess on an absentee ballot you can just write on the ballot, but we vote by touch screen for in-person. I don't think they thought this plan through (unsurprisingly).

They can just write it on the machine with a Sharpie, and then complain that the machines are rigged when the vote isn't counted. Easy.

I always operate on the assumption that I need to be prepared for the consequences of everybody I have known or will know seeing what I've posted online. The whole anonymity thing is unhealthy IMO. Hence using my real name on this site with the exception of one letter being wrong due to a typo when I registered way back when.

I have to wonder if trump and his group anticipated a massive democratic victory that they could challenge and say "look at all they won, it was only done through FRAUD and CHEATING!" and I think that would have landed better. Because they do appear that they were totally prepared to do that very thing. But when that didn't happen, they just went with it, because the presidency was lost. The big problem there being that cheating and fraud should have removed high ranking republicans and given the Senate to the D side. Their argument is weakened greatly as a result. Some clearly don't get that, and will believe whatever they hear, but to defend that in the courts, where there was a varied mix of results, just feels like a pretty substantial overreach.

I know it was an unnecessarily "traumatic" 2-3 weeks of uncertainty. But I'm glad we went through it. It shows our election system, laws & courts are healthy albeit with flaws.

We need a bi-partisanship group to review and mitigate these flaws for the next round. This process has made us a better.

Strange. I came to the opposite conclusion. This was a dry run that left us badly damaged and provided an even clearer playbook for a smarter, more coordinated effort to succeed.

And it is not over. Nothing is likely to change the election results, but there is going to be a continuing of the attacks on this election results. It is not going away, and probably not even after Biden is sworn in.
