In California, it's up to the employer to not hire a potential employee based on testing positive for MJ. I'm a card holder, and I haven't had to deal with this yet, but I imagine at some point in the future this situation will arise.

I have a friend that lives in San Francisco, and he said something I'll never forget, and I think this sums up the thinking of most people in and around the Bay Area...

"I would never work for a company that required me to take a drug test."

My guess is, at some point in the next five years, most employers in my area are going to look past testing positive for MJ and look for harder drugs that, you know, are actually harmful to your health.

They can't, but they don't have to enforce federal criminal laws either. So Colorado can say they that THEY won't arrest, charge, convict anyone for marijuana, and in fact, they don't even have to have a law that criminalizes marijuana - but they can't stop the federal government from enforcing federal drug laws within the state. (edit: If Colorado tried to pass a law that said that the federal government couldn't enforce drug laws in their state - THAT would be a conflict).
