Burglars rob house, discover child porn, turn pervert in (and avoid jail time)

Interesting the these two got off. Even if it was a slap on the wrist, they deserve something. Still, good for them for nutting up and getting these asshole off the streets.

Two burglars looking for blank CDs in California instead found a man’s child pornography stash and turned him in, Fox40 Sacramento reported Wednesday.

One juvenile and a 19-year-old broke into Kraig Stockard barn in Delhi, Calif., on Sept. 12 and stole 50 CD-Rs, which Stockard later reported stolen.

"I'm kind of surprised that he wanted to draw attention to himself, knowing what was taken," Deputy Tom McKenzie of the Merced County Sheriff's Department told Fox40.
When the pair took the CDs home to burn music, they discovered that more than 30 of them contained child porn.

They reported the contents of the discs to the sheriff’s department.

"[A] family member convinced the two suspects to come forward, they contacted law enforcement," McKenzie said.

Investigators served a search warrant on Stockard’s property and found three desktop computers and three laptops. It’s unknown what those computer contain, but authorities believe Stockard has been downloading the images and movies since 2004.

He was booked into jail for possession of child pornography and posted his $25,000 bail.
The two people that found the pornography were not arrested for the burglary.

"We did not actually go out and arrest the suspects for the burglary. They were obviously the lesser of two evils," McKenzie told Fox40.

The burglars' case has been turned over to the Merced County District Attorney’s Office for review

That sets a pretty bad precedent then. And what are the chances the two knuckleheads burglarize again? I'd say around 100%.

Damned if you do, damned if you don't, I guess.

If you prosecute anyways, you send the message that "it doesn't matter what you found and how much worse it might be, if you step forward, you're going to go to jail for what you did." In that case, burglars who discover distasteful/criminal acts committed by their victims just aren't going to speak up. Why take the fall for the sap you're robbing?

On the other hand, as you point out, letting them walk sets a bad precedent. Get off scott free, and it's likely they'll go back to burglary. The question in that case is, were they booked? If so, do the police retain the fingerprints etc?

If they do, then the chances of those knuckleheads getting caught if they break into homes in the future maybe goes up.

If they were "only" stealing blank CDs, the risk probably wasn't that high. And I imagine they'll have a bullseye on them. And it's only a town of 10,000 or so...which probably helps too.

Wacky story though. As in "why the fuck were you stealing blank CDs?"

So if cops think you have child porn they can just break in now without a warrant, since they aren't going to prosecute the person that finds it anyway...

Except if you read the story, they did execute a search warrant.

Presumably, the judge who signed off didn't think that the criminal activity of the informant amounted to 'fruit of the poisoned tree,' but I have to think that'd come up in appeal somewhere down the road.

Despite the porn guy being a total loser and deserving punishment, if he gets a good lawyer I can't see how they wouldn't find a loophole in this. Collecting evidence illegally? He can probably get it thrown out of court pretty easily.

The police didn't do anything wrong here. They criminals (presumably) weren't working at the direction of the state or police. Your 4th amendment rights aren't violated when a criminal breaks into your house. There's no basis to exclude the evidence (from the article).

In the third act of this TV show, we will figure out that one of the boys was actually molested by the guy, and stole the discs in order to get the police to investigate.
