Should they be compensated for their likenesses? That's a slippery slope because how do you do it for just a video game and not all the other stuff (like minor league teams using their likeness for promotions). How to you determine how much to pay them? Do you do it individually or make it a blanket compensation? If the latter, is it really fair to pay "Joe Blow" Quad-A slugger the same as "Hotshot Prospect A"? Once you determine that they should be compensated for their likenesses, you've now opened up layers upon layers of questions/issues.
It's a tough topic....that's for darn sure.Play the games you love, not the games you want to love.Comment

I'd view a few years of minor league baseball as an internship with an opportunity, not a guarantee, at a major league career. a person shouldn't expect to be well-paid for minor league baseball anymore than they should working at McDonald's or Walmart. you use those jobs as stepping stones or stopgaps. should minor leaguers make at least 60,000 a year? probably. I got no problem with that. but they should have not a backup plan for when they most likely dont play MLB baseball but a front-plan for what they'll do to make a true living once their internship in minor league baseball is over and baseball isn't part of their future. if any player feels strongly enough about being in a video game w/o proper compensation, they should take a stand and not sign any contract giving away their rights to likeness. To put it in perspective for you, a good majority of them play for what basically comes out to below the minimum wage when you account for the hours they put in.
A majority of them have to find sponsor families to stay with or they split extremely small apartments 4 ways (or more).
They get a small per diem for food when on the road.
I could list many more but your example is ludicrous.
Sadly, there is actually a better chance that the college athletes you are referring to get much more in kickback than minor league baseball players do.Comment

Informative. I typically get The Show within a week or two after release. The day this news became official I preordered. And now, after this piece, I'm even more excited as it's not just minor league names. In addition to their names and likeness some of their signature styles are captured as well. This is really cool to me since I have closely followed the murky likeness issue for close to a decade now. I'm happy to see that some sort of structure (I understand this only applies to minor leaguers as they sign their likeness away in their minor contracts) is in place for this sort of thing in sports gaming.

In regard to why real minor leaguers can now be in the game, I remember back to Tony LaRussa baseball. One year they included real minor leaguers. It is my recollection that as a result they received a cease and desist letter from the MLBPA. They included fake minor leaguers in subsequent years. The contract with the MLBPA forbid using the real names of players not in the union.
I suspect a similar provision was in the old contract with SDS, but is not in the new contract.

None of these minor leaguers are being restricted from profiting off their likenesses. I'm sure Tebow has endorsements. If Nike wanted to give Wander Franco 100$ million to endorse shoes they could. Basically, the market for their likenesses isn't being capped. Let the free market do what it does and get out the way.
A year ago Zion Williamson could not make a dime off his likeness, all the while Duke was charging 2 to 4 grand for tickets (which I think is fine, let the market do what it does...) to the North Carolina game. Zion Williamson's Jordan shoe deal is 75$ million dollars, his rookie contract is about 45$ million over 4 years.
From what I understand, once these guys get called up to the Show they will be paid like the standard MLB player for their likenesses in game. It looks like a win for all involved to me. The minor leaguers win because the vast majority wont make it to the Show anyway, it must be cool tell family and friends to check you out in the new baseball game. You dont have to download anything from the vault, grab the game and check out my team, there I am! Gamers win because we get to start our franchises sooner with the actual players which makes for a more authentic experience. The Show wins because if a guy is called up and he's on fire they can market him in game and DD.Comment
