The way 2K made the deal, they signed an exclusive contract with MLB for third party developers, but leaving it opened to first party developers. Basically, companies like SCEA, MS, and Nintendo can make a baseball game under the deal the same way 2K can make theirs, but companies like EA and Midway cannot make a baseball game. -
