I found this article in a thread on the Madden site. While it specifically addresses the NFL it also mentions MLB and could have an impact on MLB 2k10 and a possible MVP 2010, etc.

It will be a glorious day when license exclusivity is forever banished from sports gaming.

We really got hosed, didn't we? The best football game designer gets locked out of football, and the best baseball designer gets locked out of baseball.

MVP was so friggin close to greatness, especially with what EA put together for the college game in 06, I can't believe it's gonna be another 3 years before it has another chance.

I'm guessing that the NFL isn't too dissatisfied with their deal with EA, though. Even though Madden is a steaming pile of ****, it's the cash cow of all cash cows, and likely isn't doing much to tarnish the NFL name.

2K, on the other hand, has been pushing this abysmally horrific excuse for a baseball game for years now, and I don't see it doing any good for MLB's growth, cuz, let's face it: a good sports video game generates interest in the sport it represents. And 2K's game has been sucking for so long, it's probably forgotten how to NOT suck.

Shame on Microsoft for not making a baseball game, though. There's no reason they couldn't put something together for the 360.

Ah well. At least hockey's in good shape.

interesting, but even a win by american needle still leaves open the possibility that EA and 2k will be able to distinguish between video games and clothing contracts. And even if they can't, there is still the 5 year process of the court case should they not settle. Which EA might predictably not do. This is a long term thing is what i mean

In all reality they probably won't win. My hope is that the threat of the suit causes NFL and MLB to look at the whole "exclusive license" thing and realize it may not be worth the hassle.
