Here's how it works, if you are in the union then the game gets rights to your name and likeness when they buy the MLBPA license. However, players not in the union can appear in the game but since they are not in the union a seperate contract needs to be established to purchase the individual players likeness rights. As of right now, I know that WSB did indeed purchase Matsui's rights and he will be in the game. Games rarely do this unless they feel the player will be a big part of his team that year like Matsui. That is why they did not include players like Jose Reyes and Jose Contreras, though Contreras is in WSB as the fictional guy mentioned before. It's really a developer by developer decision as to whose rights get bought so you may see Matsui and Contreras in other games but it has nothing to do with the date of rosters.
