It's not looking good for the home team.
I guess there's still a small chance that he comes through tomorrow, but I'm not banking on it. If this falls through, then I doubt that I'll take the $100 deal. Ever since these new systems have come out what I've noticed on Ebay when it comes to Next-Gen games these sellers have been becoming a little tricky especially with the wording of there listings. It seems they give you just enough info to reel you in and my guess is hoping once you figure that they won't provide the game early but they will provide the game at some point at or near release that you will say F/it and just ride it out with them as long as you get the game.
Majority of these sellers know damn well they are not getting the game IN HAND till near or end of the week.

Try going into your purchase history and clicking on the order. For there there's a drop down menu that has a place to cancel your item. I would also select "resolve problem" so that you get eBay involved. I think eBay will give him 3 days to respond, but ultimately you should get your money back.
