In Colorado, that's a misdemeanor that is punishable up to 1 yr in prison They are tough on any type of rapist acts or such out there.

According the legal experts on TV, the reason he wasnt charged with false imprisonment is that they didnt want to make it easy for the jury to let him go.
Meaning sometimes a jury will find someone not-guilty of a major crime but will find the person guilty of a lesser charge.
I think thats what happened with Ray Lewis, He was acquitted on the murder charges but found guilty of the much lesser charge of obstruction of Justice. That way the Jury can always bail themselves out. But the prosecution really loses a conviction on a misdemeanour means nothing to them. All or Nothing.
So thats the only reason they didnt charge him of that also.
