Regardless if she sneaked up to his room, if he raped her, he raped her.

And the whole, "Kiss it before you leave" doesn't really have anything to do with what happened before he said that. It just is a weird statement as SportsmanTO pointed out. It makes Kobe to look like a weirdo. So her not telling that to the police doesn't have much bearing IMO.

The whole bleeding issue, yeah, raping her wouldn't necessarily cause that. It's just that it's more ammunition for the prosecution.

I think if you look at Colorado newspapers you'll get a totally different story today as well.

All I have to say is that there would have been bruises to day after if he had hit her or stangled her as accused. Then the argument that the tears could have been normal of someone who slept around will leave doubt in the jurors minds. She kissed him the felt each other up and she said she had to go, just sounds fake to me. if your kissing or getting to second base or whatever you dont really keep track of time. So I doubt she left because she needed to be home. And If he didnt start getting serious until she tried to leave then she didn't try to leave originally because she was scared. So I dont think she left until She also left things out of some interveiws that she has in others and that can really hurt her case. Someone being raped would scream at least once, especially if you know that there are plenty of people around. She snuck it to his room, gave him a private tour, and they had sex. I dont know if this is true, but one of her freinds said she bragged about sleeping with Kobe. as well as an incident at an old american idol tryout. I just think that she doesnt have much character here, unless she has a very convincing testimony. Nothing in the evidence proves rape. The only thing that comes close is her testimony and I dont think she has any more credability than Kobe. I think there is too much doubt to justify convicting Kobe. But of course that is what the rest of the trial will be for.

This is only a prelim trial. This isn't a criminal case. The purpose is to show just enough evidence to show if a trial is needed. The DA hasn't presented much of what he has. The detective was cross examined and that's all. We are all speculating here, and they have the real evidence sealed up. If she told Kobe no, he's in for it. If he lied about it all, and said things in that interview that is consistant to her story, he's in trouble.

Until the trial starts, we really don't know the deciding details for the charge in the first place.

I don't see how Kobe gets out of this one. I honestly believe that he thought he was having consensual sex with her, but because she was too scared to say no, he, most likely an innocent person, who should of not been anywhere near Colorado, may go to prison.
